Sold my truck... what are my legal rights?

Well.... I was within 20 miles of his bank today, but was there doing a demo of a trailer and it was with the government and we all know how the government works. Needless to say, by the time I got done it was after 4 and the bank was closed. I did call them on the way down in the morning and they said "no problem" when I asked if it was good. I think I'll go back tomorrow and get it done with. Haven't heard any more from the kid....

Didn't get 20 winks last night, offended a HP on the highway tonight by going 9 mph over the limit.... time for a cold one and a pillow.
 
Pretty sure I would have found the half hour to deal with it, you must not be that worried about it.....:face-icon-small-win
 
i'am pretty sure they can remove funds from your bank if he stops payment. i have cashed a check that had bounced and they took the money back out of my account.
 
a cashiers' check can be canceled just the same as a personal check, when you buy a cashiers' check, that only means that the buyer has the money at the time of purchase, but the buyer can cancel it at anytime....good methods of payment are: cash, "wired money into your account", money order (can't be canceled by the purchaser)....experience is generally a good teacher for most people, until the memory of the lesson fades....and then retaught....guess how i learned that
 
Got the check turned into a money order, the clerk told me that it works the same as cash since they deducted the funds right from his account while I was there.

"You must not be that worried about it" - Yeah, right. We took a break from 1-2, so I drove 40 miles while the rest of the guys ate dinner, when I got to the bank, they were closed for dinner. My main concern yesterday was handling my sale and taking care of the customer while I was there, just didn't work out time wise to make it back to the bank.

I'll give him a call tonight, need to get my license plates from him and we'll see how that goes.
 
He and his Uncle came and looked at it and drove it

When I was cleaning it out after they got back from their 5 minute test drive I found my billfold on the floor, that was odd and got my attention because it stays in the cubby hole in the dash

I have the title, the bill of sale also stated the title will be released when the check clears the bank. I'll give him a call tonight, need to get my license plates from him and we'll see how that goes.

jsledder, you sound like a decent guy but you need to start paying more attention. Someone is going to screw you over pretty badly if you keep being like this.

1) nobody would ever test drive one of my vehicles without me sitting in the back seat

2) do you have any idea how many kids are breaking into vehicles for something easy to steal. Leaving your billfold in your vehicle is lazy and not real smart. Do a web search on people who have had thier identity stolen and see how much of a hassle you are getting yourself into by leaving your wallet in your vehicle.

3) you let them drive away with your plates? Is this because they didn't have time to get proper insurance coverage? Title still in your name, your plates on the truck??? If they got into an accident, who is liable?

I am confused...

I thought he put a stop payment on the check?????????? At what point did he change his mind and offer to make it a money order? Did you guys figure out what was wrong with the truck? did you turn him into sheriff then changed his tune?

Exactly, why the F do people have to be keyboard lawyers????????? But then again ask a question on here and you should understand what you'll get. Yep he made some mistakes, bet it don't happen again. Sure glad* to see that most on here are PERFECT, NOT!!!!!!!!!!:mad:

wasn't my intent to bash him at all. I don't know the guy and probably never will.

I just wanted to point out that the title is in his name, he has posted here that ownership doesn't transfer until the check clears, and that his plates are still on the truck.

If the new owners get into an accident, jsledder could end up paying a hefty sum.

Trying to be helpful, not bashing the guy. He actually sounds like a decent guy.

I am not pointing my finger at you, I am speaking "generally" about this post. Like I said some mistakes were made but we are all only human. Glad that it looks like it is working out. And like I stated above, it just gets me that there are so many keyboard Lawyers on this forum..............

We do things a little different here in SD.

If someone is going to steal my billfold they are first going to have to break into my garage to get to the truck. When we sell a vehicle around here, privately and up until a few months ago, you simply made out a bill of sale and filled out the transfer of ownership on the title and that was it. They came out with a "keep your plate" program now where we are supposed to keep our license plates and this is the first vehicle I've sold in quite a while so I wasn't up to speed on that whole system, but the DOT says I'm still covered because the signed bill of sale is the protector in all this and I was released from any liability with the vehicle when he signed it. The title, that's pretty typical that you get that when it's released from the bank or when the check clears.
I'm sorry we don't have the crime problem here in rural SD that you have up there in Canada, even though I'm "lazy and not real smart" I've yet to have anything stolen from me, ever. When I travel, it's a different story everything is locked up. Not many people around here even lock their houses at night, leave their garage doors open, etc...
 
Sounds like a stressful situation, not fun for anyone....

A couple things....Always take your plates, once you have filled out a bill-of-sale the new owner has 72 working hours to get vehicle registered in his name. Keep a copy of the bill of sale! Send the title after the check has
cleared.
I understand the wallet thing, I leave mine in my truck too when it is
at my house, not lazy, just habit I guess. I suppose it depends on where
you live, if the truck is locked and in a locked shop/garage it's probably
as secure or more so than in the house.....
