My Little brother got an MIP & a DUI last night out of state.

Your horse is getting so high a t-pex couldn't climb it. This one beer buisiness is rediculous. If you were a 90 pound woman that had never consumed any alcohol one beer might cause a significant level of impairment. If you a normal sized person that drinks alcohol occasionally one beer is not going to cause anywhere near the impairment of many other common factors. Have you ever driven while tired, driven while on the phone, driven while fiddling with the radio? Have you ever driven with a dog in the car, kids in car, or involoved in conversation? We all agree that driving while smashed is stupid, irresponsible, and dangerous. Driving after a couple of beers is probably not the best idea but it is no different than many other distractions.

Yep I've done and do all those things.The big differance is none of them are against the law. At least in MT. When they do become against the law then I will either comply with the law and if I don't, and get caught, I will not whine about the consequences.

If the keys arent in the vehicle you can't get a dui- I wouldn't be so sure on that....if you are in the car with or without keys they will assume you had them at some point, thus intent or did drive. Now just because you are charged doesn't mean the judge won't rule in you favor...just not 100 percent safe if you are in the car at all.
 
in 2008 32% of car accidents were caused by drunk drivers, so that means the other 68% were sober drivers. Hmm? I think if you cause an accident you should face the same penalties as a drunk driver. Is it ok to take another life because you were too busy phu(kin with the radio, or too busy texting or because you are a $hitty driver. The fact is D&D just has a bad rep, but studies have shown that driving tired is more dealy than driving at a .08 to .1. I wonder what happen to those 68% that were sober, what a $50 ticket, and a slap on the pee pee? if you cause harm to a person or property you should be charged with a crime, regardless of the situation under the influence or not.

Ya know, You can twist the facts however you want to try to prove your point. Fact is that there are probably 20,000 or more sober drivers on the road for every 1 alcohol or drug impaired driver. (DUI is DUI whether it is drugs or alcohol) So if there are 20,000 more sober drivers on the road than drunk drivers, shouldn't it stand to reason (using your reasoning) that the pecentage should be higher. Fact is I'll take my chances on the road with the
20,000 sober drivers than with the one drunk driver.
Now find your little study that compares the accident rate between 20,000 sober drivers and 20,000 drunk drivers. I'd bet $100 dollars that the 20,000 drunk drivers have a higher accident rate.

usally a dui accident results in a death. people have been charged for vehicular homicide for falling asleep before.

i guy i worked for got his dui that way. it was winter sleeping the back of the car with engine running at a grocery store. he never drove he was dropped off there after a party. thats pretty low if you ask me

I'm sorry your kid brother got himself in a bind.
I'm also sorry that some on here are making such a huge thing out of it.
It doesn't make him a bad kid.
It doesn't make you a bad big brother.
It simply means he drank, he drove & he got caught.
Well, he's a young kid & it's not uncommon behavior for that demographic.

To those of you who NEVER drink and drive, kudos to you, that's very wise.
But to use that in an attempt to shame others has ZERO motivational value.
I D&D frequently, but I always try to stay at or below what I would my legal
BAC would be. I am sure there times that the legal line is crossed, but at those
times, I am aware of it & drive even more cautiously, as to not do anything to warrant
being pulled over. I honestly don't believe I am endangering anyone including myself.

You know whats funny about this whole thing is that so many of you are so willing to kick someones *** or frontier justice someone for stealing a snowmobile or blocking you in at your favorite riding spot or shooting your dog or hit and running your car or countless other things taht have been *****ed about here. But when it comes to DUI you want everyone to have a free pass. Go figure! I am so done with this thread and I am sure many of you are happy about that. I hope none of you ever loses a loved one due to drunk driving accident. If you do I would like to talk to you and find out how you feel about it then. I'd bet your attitude will change.
 
i never have or never will drink but there are some people that just shouldn't drink, they can't handle booze at all. now my dad and uncles that have drank beer basically everyday for 45 yrs have no problem when driving after 4-6 beers. it's the people that get so plowed and drive that should be in jail but i believe that some people can just handle it better then others

I agree, but how could one decide if one can handle alcohol "safely"? A cop sees you swerve, he pulls you and you blow a 0.08+. Maybe you swerved because you were reaching for your radio, maybe it had nothing to do with the alcohol.

But maybe its the other case, maybe you have a very low tolerance and you are drunk off your azz at a mere 0.08. What should the cop do? I vote take it safe, what do you vote?

nope I am not twisting facts those are the stats 68% of accidents are sober drivers, done; what don't you get? like dui for hire or did you mean higher?

no doubt driving tired is BAD news.

I've made the 30 minute drive home after doubling into an overnight from a day(ie no sleep since 4am Thursday(work 7-3:30) and working till 7am Firday(11pm thurs-7am Friday)). And I have had some stupid close calls and drifted onto the rumble strips way to often.
 
Very valid point and it should be the point of all points. The best point made yet, how did we miss that? Sounds liek this kid is turning out better then Nate so Nate did something right!
