I'm Venting.....

Good on you Nate.:beer; every man over 18 should never leave the house without a side arm!! you handled the situation admirally. I wouldn't have let the cop put me in the car without putting me under formal arrest. without commiting a crime he had no right to put you in the car. probable cause to search doesn't mean he can arrest you.( you could have been standing there and protesting the mistreating of your property!):mad::mad:

Now I am not agreeing with the cops actions, but yes he was right in putting him in the car while searching. He is busy checking a bunch of guns, so he puts nate in the car for the cops safety. If nate was a nut case person, you dont want to have him go off crazy around all the guns and stuff.
 
I understand the rational behind him putting him in the car. But if the cop was uncomfortable than he had no buisness doing a search of a vehicle with weapons with out another officer present. I wouldn't get in a cops car with out being mirandized.( maybe thats just me). My hats off to the police, they've got a Fuked up job, but I've seen alot of wild chit at the young age of 35 and would not let a cop alone with any of my property unless I was arrested and mirandized.
 
I know I will catch hell for this but here goes. Should have left the dog lay on the road and went on your way.(once you confirmed it was dead of course) After a couple of days the dog would have been just a dark spot on the blacktop. If the owner did not care enough about the dog to keep it tied or fenced up then why should you care. On a lighter note I worked at Cordero in 76 and 77, I thought Gillette had matured some since the 70's but guess not. Seemed like back then someone was getting shot evey week. Glad no one got shot or stabbed on this one.

I'll be polite here... You don't have a clue. But you will get yourself in some losing arguments with bad endings with your beliefs...

He made himself comfortable by securing the unknown... Pretty smart, yea? What, every time an Officer isn't comfortable he needs to wait? Oh, I'm sure you'd like the results of THAT philosophy within our society after all the dirt bags caught wind of it....:rolleyes:

Miranda is only if you are asked questions after you become the focus of the investigation. And that doesn't include name and birth... tricky stuff this ain't. It's got nothing to do with the ARREST.

You can be detained, secured, held, whatever, and not formally "arrested" as everyone likes to think, or, you can be arrested and then "un-arrested".. it's pretty niffty stuff, but it isn't anything like what you think it is.

Good on you Nate, for keeping your head. Old age probably would have pushed me to leave the dog, but having gotten yourself into the situation, you had to finish it out.

Simmer down good to go, if you want to jump in go ahead, I was simply stating what I would have done. Nate handled himself well through the whole thing. and your wrong about miranda your rights must be explained to you anytime you are arrested, it had nothing to do with investigating after the fact. that is the whole idea, you have rights and the police must respect them. And don't assume to know what I think about what we should do about "dirt bags" in out society. I support the police in my area but they are a solution after the fact thats why I'm packing too. If more people did than maybe the cops wouldn't have too worry about so many dirt bags.:)
 
No worries here.. just that incorrect info is just that, incorrect. Happens alot on this 4m..:rolleyes: I'll repeat: Miranda has nothing to do with arrest. There are times a person needs to be read their rights prior to questioning, even if not under arrest; and fact is, the majority of arrests occur without triggering a requirement for Miranda, hence, they're not read. But hey, go ahead and "tell" the cop what you will and won't do, what he is supposed to do and why. Maybe it will work for you... but I wouldn't bet on that horse..:face-icon-small-hap

I wished more people packed. Period. It's absolutely true that guns in citizens hands deter crime, so good on you too. And forgive the misunderstanding, but I didn't intend to pretend to know what you were thinking; I was pointing out the reality of a course of action (or in this case, inaction); as in not doing anything because a cop was 'uncomfortable'. Bad policy. Policing can be both reactive (as you point out) and pro-active, which unfortunately doesn't happen as often due to liberal thinking, lawsuits and of course, laziness (easier to just sit in the car and wait for a call, no??).

So, no, I'm not wrong about Miranda. But, appreciate your views. :beer;:beer;
