Contractors not paying??

How much do you Subs get into these Contractors for before you realize they aren't paying you? I've never understood why Subs continue to work once they are more than a month out. Afraid of losing the work to another Sub?

Minnesota construction laws require specific pre-lien notification, if you didn't provide that prior to work starting any lawyer or resident for that matter can get the lien tossed pretty easy. Then turn around and sue you for slander of title.

With how easy it is for a builder to fold one company and start another I would have my paperwork in order before starting and not let anything get over 2 weeks out. If the builder can't do that then let the work go.
 
Unfortunately, liens and bonds are not a simple solution.

For example, in Seattle (King County WA), once you file a lien, it takes 6 or 9 months (cant remember which) before the lien filer can foreclose on the lien. Once they file for foreclosure on the lien, the courts are backloggged 12-16 months out for a hearing. So essentially, you are 18-24 months from the time you file a lien until you actually get your day in court. And then, you better have your ducks in a row, or it will be continued or extended....or it can be thrown out and you have to start all over again. That is why good lien attornies cost $4-500/hr. And most of the time these conflicts end up in mediation or arbitration where nobody wins except the attornies.

Bonds are another story...if you lien your contractors bond, now you are not only in a fight with the contractor, but his bonding company as well (which is usually a large insurance company). Do you think they want to pay? They are going to do everything they can to get you to go away.

It can get ugly, and unfortunately most smaller contractors dont have deep enough pockets to see the fight through.
 
Interesting, I've got this exact problem in my lap right now. Job done, broken promises to pay, still waiting. Lein on the property but I want to go undo the work and knock the owner down.
 
my buddies a well driller and has alot of people who owe money for service calls $200-$1500 and has someone lined up to keep an eye on these guys credit if they open up a new credit card or have a credit card with an open balance he just makes a charge on there card with out them knowing and he says it is perfectly legal? the guy gets 50% and it has been working out for him.

wow that sounds really similar to identity theft. I do excavation work and if I get more then 2-3 weeks out I just go down to the utility owners office and sit there until I get paid. I just tell every person that walks in the door about how I haven't gotten paid for work I did and ask them what they think the company would do to them if they didn't pay. Only had to do that twice. Bad public relations is worse than bad credit any day.
 
I have a freind that has an auto repair business and says he has 3 different construction contractors that have been into him for a total of about $12,000 for several months now. His shop is very small and that kind of money is very serious for it. He doesn't know what he is going to do to get it.
 
If you take the materials with you, it could be considered theft. It can also be considered trespassing. Not many cops will haul you off for it, but if the builder presses charges they have no option.

Not if YOU provided th materials in the first place.

Edit... and if you do this, you are NOT going to get paid. I would probably not do this unless I knew the contractor was about to go bankrupt/under. You would be far ahead to go the lien route first.
 
Collection agency...........that way it affects his credit. anyone who runs a check sees he doesnt have his bills pd. They also tend to be MUCH cheaper then leins and lawyers.........and your more likely to get more of your money.

Another waste of time. The majority of these guys that aren't paying are deadbeats to start with and you can bet dollars to donuts they have crap credit anyway.
 
It amazes me how many crooks there are out there. How do people do business like that?? I have had 2 guys totally rip me off, but in the opposite situation. I had a stone mason take my money upfront and run as well as another company do the same. total of $26,000. I called the cops on the stone guy but since he got a small stack of block delivered, a value of about $300, he technically has started the job and had 2 years to complete on his contract. man I was pissed. guy totally dissapeared and I had to hire someone else. I can see why a builder would not be crazy to pay contractors real quick, but to not pay them as all is really messed up. I guess alot of builders, dont know how to manage thier money.
 
I think the bottom line for me as both a General and Sub Contractor, depending on the job, is I need to know who I work for and who is working for me. Where I live, news travels fast and most people know who the jerk offs are that don't pay. Times are tough now but most of the guys that are not paying now more than likely havn't ever paid ther bills ontime.
 
yea, some people confuse me... the same guy who can't seem to get enough money to pay for a couple jobs calls and asks us to do a kitchen remodel, then when we decline (with more words) he calls back a couple hours later and asks again and the , you sure? hmmm I dont know how people can screw you out of money and still want you to help... I'd be worried when the people actually NEED the money to get by and their the only one's who owe you it... someone might loose some sleep...:devil:
 
get a hold of the finace comp.around here the banks cant pay out the last draw and let it go to the morg. untill a lein release is turned in from all subs.
ect.if they do they (the bank) gets hit with the bill and has to pays it. it can take time and a pain in the ***.
