Contractors not paying??

Just dealing with more BS some more builders not paying us... You guys got any stories on how you got even with a builder who didn't pay you.. Looks like might be bringin' another load home soon... Last year drove to Naples, FL from MN and picked up a nice little $140,000 boat out of his driveway :) gets the blood going a little.... I'm pretty fed up with people wanting the work done then not payin...
 
You file the lien on the property, not the home. If the builder and the property owner are not the same, the property owner will have to pay and then go after the contractor.

I have 2 contractors that I have had to file liens on this year so far. The first one paid us off and now it looks like they are out of business. I got lucky and got out before they dumped on everyone. The bank has foreclosed on the property and is going after the owner and his office manager personally for fraud. The second guy is a real clown. He has about a 5 million dollar home and barn and will not pay his subcontractors. We filed a lien on the house he is building now and are waiting for the land owner to realize the lien has been filed. He also sent me a hot check a few weeks ago. It looks like I have him in the crosshairs.
 
Leins are worthless unless you have the money to buy the house, also the lumber yard will have the biggest amount so it doesn't help us.. The builders just let the houses go back and fu(k everyone... it begins a vicious circle......

a neighbor to a guy I know is a contractor... 5 guys pull up in security outfits ask for the guy at the door he comes out to see whats going on... 5 sub's that are owed get a little justice with a little beating landing the guy a nice vacation in the hospital... There needs to be ALOT more of that maybe some people will understand..

That is GRAND THEFT, bad idea. It might get you your money but it could land you in prison.

File a lien like the others have said. Contact BBB, State Attorney General, owner of the building the work was done for, etc.


Taking his property is a bad idea, legally.
 
I remember when my grandpa still owned our shop before my dad took over. He did a whole motel full of windows. They didn't pay for 4 months. He went up and started taking them out one by one. You'd have to know my grandpa, you don't mess with him when he's pissed.

One of the workers, started lipping off telling him if he didn't quit he'd get his *** kicked. Wrong thing to say. His coworkers packed him away. Anyway They cut grandpa a check after he had about 8 windows out, and paid hime the extra labor to put them back in
 
sawyer, im with that... like doing things like that.. nothing like guttin all the wire out of the boxes and above the panel :).. were legally not suppose to remove it from the premises.. as for taking their stuff... We talked to him and didn't give him many options... us taking the boat was the wise thing for him.. we'll see how this goes might have a skid steer...
 
Collection agency...........that way it affects his credit. anyone who runs a check sees he doesnt have his bills pd. They also tend to be MUCH cheaper then leins and lawyers.........and your more likely to get more of your money.
 
2 years ago i bought a little cabin on a lake for an investment with the intent to build a new one in it's spot some day and sell it. well i had some renters in there and they where paying there rent for about a year and the one of them lost they job and then the rent stopped coming in, i tried to kick them out and they would say i know my rights it will take you a year and about $2000 in laywer fees to get us out. talk about being pissed off one morning i told my workers take the hoe and dump trucks over to the rental. we went in threw a little bit of there **** out the door in a pile in the rain. 2 hours later we had torn down and removed the cabin laughing are as ses off. they came home from some where and no place to go. Ha Ha the only thing was left was there wet pile of junk sitting out side, never heard another thing from them. so that one way of getting rid of bad renters.
 
When he goes swimming, make sure he's wrapped in log chain to stay warm,

In certain states, Colorado being one of them it is LEGAL to UNDUE any work you have done that you were not paid for in a reasonable amount of time.

If you take the materials with you, it could be considered theft. It can also be considered trespassing. Not many cops will haul you off for it, but if the builder presses charges they have no option.

The police will say it is a civil matter, especially when the builder hasn't paid a dime and you are a subcontractor.
