As I sat in that meeting and listened to what the EPA was saying, it was very clear that change is in the wind.
The EPA basically said that if it has tags and is legal to be street driven then its illegal to make/sell anything that alters the emissions of said vehicle. I believe it was Anne Wick (EPA) that said there is no such thing as a dual-purpose vehicle in the eyes of the EPA.
The fines are fairly steep, $32,500 per incident for a company and $2,750 for individuals, per incident.
The EPA has an independent source (Sorry I missed his name, maybe somebody can add it) working on a formula that might make it a little easier for tuner companies to get Executive Orders allowing for street driven tunes. What he is doing is measuring what the grams of Nox per HP made are stock and comparing it to what the grams per HP once it’s tuned. So if its 6 grams per HP made at 250HP stock (1,500 grams) and it makes 3,000 grams at 500hp, its still 6 grams per HP made. It was my understanding that this is still being evaluated. If the EPA accepts this, it should be better for everyone involved.
They do not care what we do at the track; they want it clean on the streets. Every time you think you’re cool blacking out somebody on the street, you just gave the community another black eye.
