Oh, and watch the knocking of the flatlanders. They got skills, they have to, cause they are much hungrier for snowmobiling and riding than people in the mountains. We are spoiled compared to them. They are mostly die hards. You have to be for 4 solid weeks of good riding conditions in a 4 month season.

But dude, you are screwed. In the end, you hit the rock. I think the lesson learned is you need to get better insurance. Getting hurt is a risk game.

You mountain guys won't ever understand the 70mph+ ditch riding, so don't try to. It's a flatlander thing and totally normal in the central areas. A good portion of our trail systems are in the ditch beside the road.

Exciting huh? Now you know why we come out west :)

I can attest to that....thats all we have here in Iowa too. It sucks:rolleyes:
 
Around here a rock that size just doesn't show up in a road ditch. That ditch is normally mowed several times a year and put up for hay, whoever mows it will for sure move that thing out of the way and it just doesn't fall out of the sky when they are done mowing. I'm with you, but...... to get it to make sense to a lawyer or judge will be like getting MHA to admit Obama pumps Muslim blood, just aint gonna happen. :D:D

First of all it's too bad you hit that rock!
I'm thinking it's reasonable to think someone (the land owner)knew that rock was placed there, just for that reason, for a snowmobiler to hit it. It also seems probable that the property owner knew the hazard. Was there any No trespassing signs on the property? Who else had any thing to gain by that rock being there in the middle of the ditch? How many miles do you need to go down the ditch before there is another rock that size? Does it certainly seem likely that someone placed it there?. "The fence was down on the property?" I thought I read that. Right close to there? Take pictures then.
I think it is just like someone that digs a hole in the middle of there own drive way for maintenance purposes if they don't put up a (WARNING SIGN) it rains and fills the hole up with water and you drive into it. Seems to me they might owe you at least a little something..
I'm a little pro snowmobiler so sorry, I guess I can't really look at it from the home owners point of view here. Maybe he thinks sleds riding too late at night and it wakes him up and so, he wants to kill all us infidels. Maybe he dreams about a unmanned snowmobile flying through his living room window some night with no identification of where it came from.
Who knows? maybe the rock is just laying where Jesus flang it. I really don't know what happened I'm just happy to see you wrote this and didn't die and you are recovering and are *****ing and moaning about the accident. Its so good to be alive! I do think you have a good point where you can sue the land owner I think by the time you're feeling good you might just forget it or put a cool video on Snowest with a snowmachine flying through a living room window in the middle of the night. What ever you do you have allot of time to think about it.. Don't do anything illegal it will make you as bad as him. Always stay within the letter of the law. Good luck with your new sled! Ride careful!!! And yes sue him if you truly believe he placed the rock there. Who cares if you lose. It will make him think next time he tries to kill someone else.....
 
if the rock is still there put it in the middle of his lane on the public side.

i hate people that move rocks into the ditch, and throw garbage in them. but since you have pics, i would ask the farmer if a ufo or a uro(unidentified retarded object) moved the rock in the way. like someone said, when they mow the grass, the driver moves the rock. the rock doesnt move back unless someone moves it.
 
update on the insurace.

Yes the fence was down it would have been easyer to fix the fence I would think anyway. From what i have hurd is that he put it there to keep pheasant hunters out of his feild, the whole quarter was CRP that they had hayed part of it and they would bring bales of hay to the road and they took the fence down right there to get access to the ditch. Now i am not sure if there were alot of hunters in and out of there or not but i would have just fixed the fence that would have kept the hunters out if he was haven a probblem. I guess he never mentioned to us (since he is a neibor) about any hunters being in and out of there but who knows we dont talk very much. I did contact his insurance company last thursday and i guess he had called them a few days after they hurd i hit the rock. The insurace company is trying to say it is the countys part of the ditch and the county said its the farmers part hahahah aint that sweet lets point the finger well i told the insurace guy that if you want to get technical the rock was half and half so who knows, he said he wouldnt give me a offer but was not denying me until he looked more into it. But he knew alot more than i had told him. I think he has Talked to the county adjuster he knew things about my insurance and stuff that only had been told to the county adjuster. But who knows i am going ot pursue it till i have no further options.
 
Sorry to hear that travydog, you been wronged bad.

You oughtta go talk to the guy, explain your story, and show him pictures of your mangled leg and show him your bills. Only a complete scumbag of a human being wouldn't feel remorse for the pain they caused you. He may hate sledders banging the ditches, but what he did was wrong and very malicious and could be argued to be attempted man-slaughter and land his azz in jail for a long time.

Maybe you should print up some posters with the details and post them around the towns and countryside. Just say what happened and who's property the ditch was adjacent to, add some pictures and midical bill totals, but don't slander him directly. Let the people draw the conclusions from the facts. Let his neighbors see that he almost killed someone and see how that sits in his craw. That's about the only legal revenge your likely to get, unless he bragged it around and someone steps up to testify.
 
well its been a month since i have hurd from there insurance guy he called on a friday morning early (didnt have me cell turned on) and said he was going to look everything over and would call that afternoon or no later than monday and thats been over two weeks ago. Typical insurance hahahah

I was on the farmers side at first, but now I'm leaning towards Travydogs side now...


all I'm going to say is, what a chitty place to set a rock!!


sucks man, I don't see you winning the case unless the farmer owned it (he'd be stupid to do that)
 
Comes a point when you have to assume and accept the risk. When I ride or drive in crappy conditions I only do it at a speed Im willing to hit something. Sure Ive made bad decisions- Ive paid for some of them- but Ive come to assume and accept the risk as my own.

The ditch bangin' is your flatlander thing- I understand it a little. But whats the difference of having something fall off of a truck, a car wreck leaving something behind, a fence falls over- every conceivable notion you could come up with for having some objective hazard in your path that you would not assume and accept the risk as entirely yours.

But when i Know he put the rock there and didnt flag it or move it or something it just pisses me off when i have to go $30,000 in debt because of his stupid ideas. It would take the same amount of time to go to a rock pile with a loader and find a rock and drive it back to where it sits now than to have just re strung the wires back up that they took down to bring hay out of the feild, it would have been as simple as that. I just cant prove that he did it in a court of law. The family is shady anyway so. I have just delt with it and accepted that i will have to pay the bills and go on with my life. But I will never go out of my way to help that family again. Even if he was on fire i wouldnt cross the street to piss on him to put him out. Ok thats my rant.

i finaly went and got the rock today it is now sitting out front of my house. Thats got to be one of the spendyest rocks i have ever seen hahahahah
 
hahahah that sounds fun!!!. To tell you what kinda people they are they about got kicked out of the crp program a few years back because they werent controling the canadian thistles or doing aything they were required to do with it the had there payment checks withheald until they complied with the goverment and man when the goverment didnt give them there check right of way they went balistick with the rep and finaly went out and cliped the thistles down and recived the check. There not the most highly recognized family in the community.
 
wow thats alot of money. I live in farm in west of iowa, snowmobiling on someone's land as long it has no "no trespassing" sign and a guy who own that land, dont mind and didnt asked him for permint. i always go slow on ditch becuase of water tunnels, fence are too close, and not enough snow...suck..!
 
Wow sounds like a bad situation.

I had a very simular experience in dec 06. Was sleddin in a ditch when I caught a rock, this one was thrown over the fence into the road ditch. I went for a good flight and tumble. After all the x-rays and 3 hospitals later I was put back in one peice. My hip had blown out the back of the socket breaking it in three places and my pelvis was broken. But nothing steel plates and 6 screws won't fix up. My hip was dislocated for 6 days until a doctor was found that could put me back together. Spent time in a wheelchair, a walker, crutches,

Rocks thown into roadway ditches happens a lot where I am from, all the farmers seem to pick rocks from their feild and just throw them in the ditch.

Thanks to Canada's health care and coverage through my work I didn't have to pay a dollar, and got 2 1/2 months disability pay.
