Polaris denied my warranty claim on engine failure cause I moved my wiring harness

Sucks is I won't waste the rest of my season dealing with this cause I know it will take time. I need to ride damnit.

??? Wow, I wish I had the coin to take this approach. Some time spent could very well get your $4500 boat anchor repaired to the $9000 sled it should be.

I wouldn't walk away from that.

It's not an easy one to suck up trust me, but yes I'm being impatient for sure. This had to happen in Feb! I'm gonna see what I can get done this week with getting a warranty out of this thing.

My dealer's mechanic said my piston seize last season on the opposite cylinder most likely contributed to the rod bearing failure I have now. Makes sense...

Even with mods....when it comes to warranty denials, they must PROVE that the modification was the cause of the failure. If they can't, there are laws preventing the consumer from getting denied on major flaws because of minor modifications. Check out the Magnuson-Moss warranty act.
Moving a wiring harness doesn't prove there was a aftermarket pipe.....and how did they explain how the percieved aftermarket pipe caused a rod to fail? I think if you pushed it with a letter from an attorney they would take care of you.....provided there were no mods that caused the failure. Good luck!
 
FLAT OUT SUING POLARIS

AS MANY OF YOU ALREADY KNOW, my warranty was also denined by Polaris last week. Same problem as CO2, rod bearing went out, took out the cases, block, crank, & one piston. My warranty was denied because of a "modified air intake". My "mod" was a k & n style air filter on top on the stock airbox that sutck up into the area below the headlights were the orginal aix intake was. The outlet diameter of the k & n was within 1/4" of the orignal polaris air horn that dumped air into the top of the air box. My airbox was stock with shelves & air horns intack. NO SLP pipe. Polaris claims that after the 2010 update, any mods void the warranty. My point is this: I have owned this sled since new, it was a spring order, it came with a 3 year warranty. MY warranty expires 2/2011 according to Polaris. My owners manual states... "modifications resulting in failure" may void the warranty. That was the warrantly I had when I purchased that sled. There is a federal law known as the "Magnuson-Moss" warranty act that says they must prove the modification caused the failture. They cannot change the terms of the warranty I purchased with that sled halfway through it. This is BULL CRAP! All I did was keep snow, ice, dirt & pine needles out of my aixbox, nothing else. Also, It siezed twice last year, had new cylinder block once & new pistons both times. When it siezed it was totally 100% stock. Anyone think 2 siezures at 7000+ rpm may have hurt the rod bearings? I have been fighting Polaris, as has my dealer and the regional sales rep for about 2 weeks. The warranty dept is holding firm.....NO WAY WILL THEY PAY.

I had a great day riding at Rabbit ears on the 2009 M8 ARCTIC CAT SNOWPRO I borrowed Saturday. 2 to 3 feet of fresh powder, no tracks, and not the constant fear in the back of my mind that my P.O.S. dragon was going to strand me a 5TH time. POLARIS I HOPE YOU READ THIS AS I WILL SEE YOU IN COURT!.. I am keeping my P.O.S. dragon in a pile of parts as evidence.

Really? Still thinking you can get something from the dealer? But not from Polaris so blast away there?

Sorry, this is a dealer issue. I've had 3 different warranty claims denied by Polaris and the dealer called up and said "No you won't deny them" and bingo they were covered.

When ever you get tired of dealing with that dealer it would be nice to know who they are so that the rest of the people in your area can avoid them.

The problem is there are polaris dealers and then there are POLARIS DEALERS.. You're in Utah where if you're dealing with the POLARIS DEALER and they take your side you're in pretty good shape..

Smaller dealers, who don't have pull with the factory, just don't seem to get the same results.

I'm the owner of 2 Polaris; 2 Doo's; 1 Yami and 1 Cat... Not brand loyal... But I'm pretty loyal to one multibrand dealer...
 
I thought about doing this but figure it would take a lot of R&D. My indydan built liberty 800 non-ves screams so it would be a strong engine for the IQ chassis...

This my indydan Torque Master built VES 800. It has a SLP single, which they make for this kind of set up in the IQ chasis. Runs great (even better than others but not going there) and I can work on it if I need to. Had a plate made for the motor mount, which are also relocated. Other then that, make sure your clutches are set for a poo belt ...1104 (10.5" center to center). You will have to mod the airbox a bit also.

its your guys delers a kid i know in reno nv had his dragon with a turbo on it and messed up the monoblock and his deler was cool about it they covered it maby poo didnt know about the turbo just a real good deler
 
No issues with electrical. Just use your wiring out of the edge. You will have to splice a couple wires to make longer depending on your setup. It is cost effective because parts are cheap and you can ride and not wait for a backordered part. Also depends what you do to the sled as far as goodies. Drop and rolls do wonders as well as other tracks.

hey CO2.0 you need to go to your dealer and tell him to fix your sled even if you put a pipe on it(which we know you didn't) they have to prove it caused the failure because like the guy said look in to the magnuson-moss act of 1975(you should look at it) because it says that they must prove what ever the modification (which we know you didn't do )done to it caused the failure so take it to a new dealer and let them fix it and tell polaris to suck it up
 
Thats a bunch of crap. They only reason polaris is saying that is because slp and most pipe manf tell you to move wiring harness when you install a new pipe. But you need to go back to your dealer raise some more hell and get him to get ahold of his polaris dsm. district sales manager because he can overtunr it if he looks at it and puts in his word. Polaris has a good warranty dept they cover everything i submit your dealer just needs to know how to write up the warranty claim.

My 2009 Assssult has had 4 top ends including the recall, egt sensors and TPS settings, reflashes, Etc., who knows what else has been done because in my oppinion they are hiding stuff. It has been in the shop over 100 days during the riding season and I have lost count how many times I have had to bring it over there. It went down again for the 5th time and my lovely dealer started with where I was getting fuel (same place they buy fuel) and I new they were working it to get out of warranty. When the service manager starts out a conversation with "were not trying to denie you claim we are just trying to get it fixed correctly for you", you know you are getting screwed again. You people need to buy a chit load of KY jelly, my butt whole is starting to bleed like a lot of snowmobilers out there who made the mistake of buying a POLARIS product that is defective. The only aftermarket thing I put on was a SLP air cone by suggestion of the dealers machanic, because of snow ingestion and I was told this would not effect warranty. Claim denied because of SLP air cone that was in their brochure. If you POO guys think this is customer service and the way out, you have completly lost it. Left sled at Dealer with blown motor before I die on it. I am hopeful that our court system will prove they produced a defective motor and that ALL of us that have had problems get it resolved. This is a dealer falling short, You can blame Polaris but in the end your dealer has let you down.
It sorry to see that a couple bad dealers are making everyone think that Polaris is hard to work with-Polaris wants there stuff to run and run right. They will do all they can if the dealer will give them the right info.

You people who think it is the dealers have not tried a warranty claim lately. IT IS THE NEW POLICY OF POLARIS TO MAKE THE DEALERS SEND IN PICS OF EVERY THING UNDER THE WOOD TO LOOK FOR EXCUSES TO DENY A WARRANTY CLAIM. Believe me I know. I spent an hour on the phone with both a customer service rep and the factory warranty tech that denied my warranty. They accused me of hiding the "slp pipe" which I never had beacuse I took the foam insulation off the hood and put silver heat tape there instead. My attornery it says they have illegally "breached my warranty"
 
slp pipe & air intake in polaris catalog??

didn't the 2008 Polaris accessory catalog have the slp pipe and air intake in it? How can they sell it in their catalog & then void a warranty because of it?

This pisses me off and I'm a lawyer, so here's some free advice. The problem with laws like the Moss Magnuson, is that you have to sue to enforce them. There isn't a regulatory agency you can contact to motivate the manufacturers to comply. I would recommend that you guys who are getting screwed on warranty claims consider two approaches: (1) file a suit in small claims court naming both your dealer and Polaris as defendants. The dollar limits in small claims court may not be sufficient to cover your entire loss, but the cost to Polaris in defending the claim will far exceed the cost of your engine. The process for initiating a small claims action is usually pretty straightforward, so you can probably do it yourself (i.e., no need to hire a lawyer). The suit will give you a lot of leverage and will likely get you what you want in the end (new engine under warranty), but it won't happen quickly. (2) Hire a lawyer to send a demand letter to Polaris and you dealer. Most states have consumer protection statutes that provide for multipliers on damages (e.g., triple damages in my home state) when sellers use misrepresentation or fraud in making their sales pitch (in your case, they misrepresented that they would fix your engine under warranty and now they are using a pretense to deny that coverage). They also often provide for attorney's fees to be paid by the seller if they lose a consumer protection act claim. If you take this approach, you will have to pay the lawyer up front, and it will be expensive, but you are likely to see a quicker response from Polaris, and you will likely get your motor replaced under warranty. In either case, there is almost no chance your case will ever get to court, because they will want to settle with you. Good luck!

Talked to some more people, including my dealer and still no good news for me. It's funny because my dealer is selling a brand new 2010 Dragon 800 with an slp pipe/can (with wiring harness moved over), and aftermarket cone type filter like Old Goat has. Guess that comes new with a 0 year warranty on it? LOL

I'm gonna split my case open and take the crank to a repair shop to see if it can be rebuilt.
