My Little brother got an MIP & a DUI last night out of state.

My little brother at the age of 17 got a DUI & an MIP last night in Belle Fourche/Spearfish. Because he resides in Wyoming what sort of precautions will they take? To my knowledge he is still sitting in Jail in either Spearfish or Belle Fourche. I would go get him but the roads there are kinda.....crappy. What is the legal process since its out of state? Anyone know? The jail called me last night around 3:30 and told me he was put in the holding tank :rolleyes:

Also....to SD folks.....how harsh are the penalties for DUI in your state? I imagine later today ill be going to get his dumbazz........so....anyone in the BelleFourche area or Spearfish wanna go down town and grab a beer or something at Sanfords? I'll buy
 
What's really gonna suck is that he's gonna have to drive back & forth for all court dates. Hopefully if he gets probation they will let him see a P.O. in wyo.
& just my opinion, slapping him with both offenses is just pure bullchit:mad:.
DUI's have turned into nothing more than a source of revenue for the law.

Well i'm not sporting a mullet YET. I am at stage 1 with my plans.

As for my little brother...well........he got tired of the split tails here in Gillette so lately he has been going to Spearfish/Belle.

To my knowledge from talking with whoever I talked with earlier this morning they will suspend his license. So I or my older bro will have to go get him. Right now i'm the worthy canidate because i'm not working, I myself am curing a hangover :face-icon-small-dis

May be able to drop the MIP but I think they are gonna slap him with the DUI. SD folks dislike WY folks, especially in the greater Spearfish/Rapid/Deadwood area haha. All I can say now is that he will probably be living at my house for a little while :face-icon-small-hap
 
They will probably release him on bond, then let him appear on his court date for arraignment. If this is his first alcohol related offense and he has a fairly clean record, they may offer him a defurral, which asks him to plead guilty but if he doesn't have any violations within the next year, they will drop the charge from his record. They do that around here with my "good guy" cases.

It is his first legal offense ever. For the most part he's a good kid. I know in Wyoming they will Defur your first DUI but I am not sure what they do in SD. I know they found 2 cases of beer in his toolbox and he came from a house with about a dozen minors all inebriated so they could tag him as the source of alcohol.

I dont know what they are gonna do to him. But I dont think it will be taken so lightly. Thank god he didnt have someone's daughter in the truck with him :rolleyes:
 
had a buddy get a DUI in Minnesota and they suspended his license for a year and tons of money in fines. ****ty deal.....good luck to the both of ya!

Absolutley right. Why do we need those ol nasty Police people. I think we should just get rid of them all because afterall laws are not made to be enforced. How dare someone think that anyone should not have the right to go out and get plowed and then jump behind the wheel of a 4000 pound projectile. Shame on them.
Nate now is the best time to teach your little brother what being a man is all about.
But judging by your post of about buying beers for anyone who will meet you at the bar there makes me think that you and your little brother will be laughing about it all the way back to Gillette. I hope not. JMHO
Forgot to ask. Who bought him the beer???????

their unending sermon about how wonderful they are because they NEVER
have a cocktail & drive.

But some of us fall just a tad below the perfect bar you have set.

If you have something that may actually help Nate's brother in THIS situation, that could

By help do you mean get the kid off without any consequences? My help would be to tell him to plead guilty accept what is coming to you and get on with your life.
I thought teaching his little brother what being a man is all about would help him.

And I am not holier than though just don't drink and drive anymore. I became a man along time ago.

Grab a beer after you get dunbazz out of jail. Not a good idea to go get him after a beer or two. :beer;:D
 
nate.. it all depends.. in south dakota under the age of 18 sometimes you can get teen court.. That is the route you will want him to try and take.. it wont go on his record and he will just have a fine, suspended lisence, some community service.

DO NOT let him use his suspended imp... For the first offense its retarded to use it, save it for a different (harsher) offence.. or a repeat..

Find out which county it took place.. If in butte county he is way better off than in lawerance.. There is 4 judges for the lawerance county system and all of them will fire the max for him.. Last dui my buddy had up there was little over 4k in fines, not including his sr-22..
 
Real simple solution on that one. Don't drink and drive. They can't get you a for a DUI unless you have been drinking. Why risk killing yourself, or someone else.......

that's why I walk....course that isn't a hit with the 5-0 sometimes either.
