Snowcheck stolen from dealer lot before delivery

The big problem for me in my mind is option #2 (get reimbursed my purchase price)... is a legal move for him if he doesn't want to comply with my demands... or so I think I understand at this point.
This Definitely leaves me short of the extra value of the snowcheck order. And if he can just do that, it gives him pretty good footing to not do "the right thing" if that's what he prefers.
 
Even if his package falls short of my expectations, it will be a better deal to me than getting purchase price refunded. I feel trapped for sure.

Exactly how I'd feel. If it were me, I'd have him try to pick up the 163 PRO 60th anniversary edition. Switch out the bumper & overstructure tubes for aluminum (he can therefore stock the CF ones, no loss to him), spare QD belt (voice your concern of QD reliability hence why you ordered a chaincase sled), 4 outer bogey wheels and mounts, steel driveshaft (he can stock the aluminum one), and obviously your bags & warranty (& windshield chosen or ES). Not sure what your relationship is with your dealer but like you said he can opt out and just give you your money back. If you start pushing chaincase swap, bulkhead heat exchanger install, etc. I'd be afraid of him pulling the plug. I agree with the others you paid for YOUR sled therefore you deserve the one you ordered, but in the end I think too many dealers will chalk it up as a "business decision" and take the easy route.
 
I want to thank everyone for their replies, and advice! I now have more knowledge about my unique situation, and some courage to fight for what I should receive.

I spoke with the manager again this morning. He offered a package including an in season Pro with a few extras, or to refund me purchase price. I told him neither would be acceptable.
I explained that I had found many TD 163 and 60th 163 units advertised for sale by dealerships on kijiji, and that to make me happy he would have to get me one and supply me with everything else I was supposed to get with my snowcheck:
-same or better warrantee
-confirm my golden ticket validity or reimbursed for its value
-e start
-storage options
-windshield choice
The chain case drive train I would be willing to eat if he supplies me with some compensation... A spare QD belt + tools or some sort of store credit.
He seemed to take it well, and said he would get back to me asap.

I also spent some more time on the phone with Polaris customer service, not much help but they did say that after all negotiations I still feel as though I have been wronged, they would follow up with the dealer to see if they can help. I have an active case number with them now.

Looks like this thread will quickly go past my basic membership ability to view but I will update what happens somehow in another thread so everyone knows how to deal with this if it ever happens in the future!

Forsure keep us updated in a new thread and the polaris cases are little bit of joke have 2 now to find out where my golden ticket is cus have had my sled for 9+ weeks
 
I don't pretend to understand business insurance but I imagine it's similar to normal insurance we all deal with.
My guess is that the insured amount a dealer would get on a new snowmobile theft like this would have a deductible of some size, and would be related to the invoice price, possibly not including the items marked $0.00 on the invoice / delivery paperwork (the snowcheck upgrades and 60th package).. hard to say tho. I have a feeling his insurance on this won't cover all the extra's he throws in with the pro for a "make me happy package".
Seems like a situation that should be covered in the snowcheck contract since we can sometimes spring order such unique hard to replace machines. Polaris should have something written so that nobody has to face a loss this way, I never had the chance to protect my sled. I have been hiding gps tech on my bike all summer and installed video surveillance on my property... I was geared up to protect my new sled.

Who cares what the dealer insured it for? How is that your problem? If he didn't insure it for full replacement value, it's up to him to make up the difference.

I insure my home for full replacement value which I know is MORE than the fair market value of the house. The parts are always more expensive than the whole and to replace my house exactly as it was before whatever happened to it is going to cost more than going down the street and buying a similar one.

I feel that this is a very similar situation. The parts are available to replace your sled. It should be replaced. period.

If I were the dealer I'd be on the phone with Polaris trying to get all those parts lined up as cheaply as I could, I'd get as much as I could from the insurance company and then I'd build you a dang sled, eat the cost difference and upgrade my security. Our local dealer recently installed new fencing and security lighting because of a theft. These guys aren't the first and won't be the last to have something stolen off their lot.

I am very loyal to my dealer and in return if this issue would have happened to them it would have been resolved quickly with zero hassle. The lack of security with your purchase alone says a lot wrong about your dealer. MH is right, keep the pressure on without mercy, they owe you. Also, study all the possible compromises: maybe a Std 163, without any of the bling, and a new 550 Voyager. Never know. 550iq
 
SNCK RMK GONE

There is a dealer here in MN (M&M Lawn and Leisure) that is the nation/worlds largest in volume of units sold. They have/had a ton of 15 Demo's RMK,PRO, Assault RMK....and on and on. Some have zero miles, still in crate being sold as used. I bought a 15 RMK snowcheck only model from them back in OCT for less than one could buy a "new" 14 hold over, or a in season 15 reg rmk. My point being, there are sleds like you ordered out there if one (dealer) was to look hard enough.

15 RMK Assault 163 with all the bags, e start, bumpers and so would be pretty close to what you ordered. They put on a wrap of your choice, make the golden ticket work, 4 year.....and go. Bout as good as you get.

On a side note, I recently was up by Peace River Alberta, to do some Deer hunting......, but I did not take your sled......

Well a couple of things to keep in mine, (think about)
Just the fact that MH has located a couple of sleds that might fit the bill and the dealer says he can't locate anything for you should tell you something about the dealer you are working with, jmo!
Now, I do agree with MH on what your position should be, however if you ever need "your dealer" to go to bat for you with Polaris or getting your sled back together in time for a big trip (under warrenty or not) that you have planned on a Friday afternoon or an issue you have with the sled down the road is he going to do all he can you make you happy at that time or is he going to remember all of this?

Lasty, I understand that everyone wants to have the sled that they want, but, (IMO) I will never pay "in full" for anything until I take delivery on it, snow check or no snow check, I don't care what there "rules" or "terms of agreement" are, to me it's just good business, once again jmo.

danbot ,here in canada if your dealer has" replacement cost" insurance you should be covered no matter what the price of the sled to get it to they way you ordered, it wouldn't cost you or your dealer anything only their deductible. you should make a call to your own insurance to confirm.
 
I'd make sure to pick it up the day it is ready!!! Heck you might even hire somebody to watch it as soon as the truck arrives:)
 
Good news!
The replacement sled was at a dealer very close, so after arrangements were made I went and picked it up yesterday afternoon rather than wait for the transfer. I still have to run to my dealer to finish some paperwork and pick up a few extras he is throwing in, but I have a sled!

The replacement is a snowcheck 60th LE Pro 163, as close to what I ordered that could be easily and quickly be sourced. I lost my chain case and extra cooler so as mentioned the manager has thrown in a few items to make me happy.

I have to give respect to Al @Gaudins Honda in Beaverlodge, Alberta for correcting this situation to my satisfaction. They have a customer for life, and I'll promote them whenever I can!
