friend totalled my sled. what do i do to cover my a$$?

yesterday my buddy did a dumb a$$ thing and passed 2 guys on the right goin about 60 mph but he didnt get past that last guy and that last guy was me. he hit my sled and flew off and he himslef hit me and landed in front of his sled and got ran over. all i remember was a bang and then i was standing up looking down at him. he ended up hooking the front end and now the whole front end except for the left side susp. is toasted. it pulled all the rivits out and bent/broke alot of stuff. he says he is goin to pay for it but who knows becasue he is a broke college kid along with me. i am goin to write up a contract/agreement with him and make him sign it and get it notorized and take pictures but what else can i do to cover my a$$ and not get stuck paying for it? i dont have the money to fix it and i dont have insurance because i cant afford it.:( if anyone has any suggestions please speak up!

Did you at least have verbal agreement? You break it you buy it !??
you may be out of luck dude. Sorry!! Insurance is very important.
Next time have your freind or friends who want to ride pay for an insurance policy of 3 months or 6 months. It's cheaper than them renting a sled.

we have a verbal agreement right not but i am about to type one out and get him to sign it and get it notorized. the sled he was riding was borrowed! i was on mine. i hope to hell this works out ok but i have seen alot of these situations and they usually dont turn out too good :(

YOU borrowed a sled and then let someone else ride it. Oh jeez. It is my guess you will end up learning an expensive lesson here. Don't forget it. :(

no i was riding on my sled and we were up my buddie's unlce's cabin(not the on who hit me) and there was an extra sled so my friend(nephew of the sled owner) called his uncle and asked him if would be alright to let the kid who hit me borrow it.
 
How good of a friend is he??? Probably wont be one for long if your going to draw up contracts, get lawyers involved and everything else to get him to pay to repair your sled.

So, he was riding a buddies, uncles, sisters, friends of a friends sled and tried passing you and ended up hitting you and wrecking your sled??? Sounds like a dumb azz move but......... you know what's coming.............. $hit happens. I would hope that he makes it right and ponies up the cash to buy the parts, comes over and drinks beer and laughs about it as you guys fix it and everything turns out hunky dory. It's just a sled, sometimes good friends are harder to come by. Hopefully he learned from it.

$hit, last year my 10 year old daughter T-boned my sled, she was riding another one of my sleds, she busted up the hood/nose cone and bumper. I razz her pretty good about it to this day, but nobody got hurt and the parts were easy to replace, all part of the game.......

doesn't sound like you're that good of friends after all... seems like a douchey thing to do to a good friend.. with the legal written and signed sh|t. trust him im sure he feels like hell

write up a little contract and make sure it says it was his fault and have him sign it. if he defaults on it...then take him to small claims court
 
Was the sled your buddy borrowed insured? If the sled that hit you WAS insured then chances are you can file a claim against that insurance company. The insurance follows the sled not the person so it doesn't matter who was riding it if it is insured.

Don't take this part wrong but if neither of you carry insurance on your sleds could you please post where you ride because I want to make sure I am never anywhere close to where you ride. Insurance doesn't just cover your azz it covers the unsuspecting person/s you may run into. Kinda ticks me off when I hear people say they can't afford insurance. You should be thinking you can't afford to NOT have insurance!
 
You can't afford insurance? My $230 a year would have written me a $10,000 check for my sled, even if he hit me, and if I hit him they would have written him a check for up to $12,000. I left a slight error in my calculation, I would have to subtract $100 from the paid amounts to pay for the deductible.

Get Insurance, *** Covered.

Although I brought up the small claims issue, I have to agree with both of these gents. After all, it WAS just a sled. & everybody walked away from the mishap. The dewd feels like chit about it I'm sure. & it's all just part of the sport.

yes i am very thankful that no one got hurt. he is one of those friends you keep at arms length. i have no problem taking him to court to get my most prized possesion fixed. he said he has no problem with a contract so i wrote one up. i just hope he signs it.
 
well...say it was carefully parked in your yard and your bud hit it with his vehicle...his vehicle insurance should pay for it then...so put a few dents in his rig...or somebodys obliging rig to make it real and get collecting...oh yea if ya want say you were sitting on it in your yard as well and get some whiplash bucks...if it was stolen from your garage will household insurance pay...put it in your garage and burn the garage down and fire insurance will cover it...heck man alot of ways to get er done....so get er done..!!!
