Everybody,

Apparently a couple:face-icon-small-fro has filed a motion for preliminary injunction to prohibit the Washington State Parks and Rec. from operating the Crystal Springs Sno-Park, our states largest!.

Here is the pertinent part of the email I received:

this my friends could be serious trouble for crystal springs, this guy will not stop at anything. If you have a list of snowmobilers send this out Get them to the meeting or this could be lost. SPEAK UP , PROTECT YOUR RIGHT TO RIDE.

Everyone--seems there is an injunction to close Crystal Springs SnoPark. Court date is Monday at 9:30 a.m. in Ellensburg at the Court House. The attorney for Fish/Wildlife/State Parks will be handling this. We need as many snowmobilers there as possible.

I have attachments for this (2) pertaining to the action, in adobe, but am not able to attach to this. I can forward them to somebody more computer savvy than myself.

PM with an email ASAP (before 5:30) and I will forward this.

From SAWS via email:

WA SAWS Members,

As if it wasn’t bad enough when Kittitas County Fire District 8 sued the Forest Service last month over their previous demands to have FS RD 5400 plowed during the winter to access their newly built fire station 83, when this same road is an existing groomed snowmobile trail out of the Crystal Springs Sno-Park, now property owners, Billy and Kimberly Beasley, whose property is adjacent to the fire station have sued WA State Parks and Recreation in an attempt to have the entire Sno-Park closed down.

For those unfamiliar with the area, Crystal Springs Sno-Park is just south off I-90 east of Snoqualmie pass and provides access to a large groomed and non-groomed snowmobile trail network south of I-90 to Stampede Pass, to Easton, and all the way to the Naches area. This is the most heavily used Sno-Park in WA State.

Read more about the Fire District lawsuit here: Fire District No. 8 sues U.S. Forest Service

Keep in mind that these folks that want the Sno-Park closed, bought their property in 1999, which was years after the Sno-Park was already in existing use.

There appears to be a very close relationship between the Beasley’s and Fire District 8, and the filing of these two lawsuits, which a win for either one of these two plaintiffs, would also benefit the other. Both lawsuit are directly related to being able to plow FS RD 5400 for local property owner and fire station 83 access during winter.

Court date is set for Monday November 21, 2011 at 9:30 a.m. at the Kittitas County Superior Court, 205 W 5th Ave Suite 207, Ellensburg, WA.

If you decide to attend the hearing, this is the place to respectively show force in numbers of snowmobiler in support of the Sno-Park, but this is not the place to holler out your disapproval with the suit during the hearing.

Details of the Beasley’s complaint can be found at the following two links:

I will be there! for those looking for details and not looking to download the document. This guy is a resident of the sawmill flats area (RIGHT UNDER THE POWERLINES NEXT TO THE "DONATED" FIRE DEPT) dont confuse these with roaring creek, residences from roaring creek stated at the meeting that they do not support this action. The homeowner is one that plowed the road in the middle of the season last year. This has been going on for awhile now. He lost against the Forest Service for plowing the road. and NOW He is filing an injunction against STATE PARKS to close the snowpark entirely. He states that there was no Environmental Impact Statement done for the snowpark. He mentions that it is effecting his land and home, that people are trespassing and "running a muk" within the area. There is no enforcement and that people are riding their snowmobiles under the influence. There is oil and toxic substances dumped. He wants the snowpark closed until an impact statement is done and that there is more REGULATIONS. There is a long list of things that he wants to happen before it can re open. And he is using "environment" to swing some weight his way, we all know how that works. This injunction has been filed completely separate of the fire department. The fire department's INJUNCTION is to plow the road and the other is to close the snowpark. The courts are not going to like all the problems this area is seeing. Lets show our support and keep this open, according to his deceleration he is say 40,000 users are using this that is a lot of people to be shut out :lock1: over one homeowner. SHOW UP TO THE COURTHOUSE be quiet and lets show support in numbers!!!! dont want to loose this snowpark.:boxing:

Wow. This is the kind of thing that drives me nuts. One person can screw 1000s just by hiring an attorney. If this lawsuit doesn't work, he files another one. Doesn't matter that the sno park was there before him. Doesn't matter that thousands of people use it, that we as tax payers actually own it. It's just up to a judge who may or may not agree with us. What local politician would be the "boss" of this area. We need to put some pressure on the fire dept to withdraw their suit too. There has to be a way to work with the fire dept so they get what they want(access) without closing the sno park.

The attorney wrote "hydraulic liquid" lol

I think the homeowners are in the right about the nuisance and having people on their property and such. But then I remembered they bought the property right next to a sno park.

Wasn't the snow park there BEFORE they bought their property?

Answer, YES!!!! I can remember riding there when there was nothing else up there other than the ski cabin.

UNBELIEVEABLE, selfish f'n people.

BTW, that snowpark has been there since either the very late 80's or 1990-91 at the latest. Prior to this park's location, the old crystal springs snow park was out on I-90 directly across from Gold Creek East snow park.

What can we do if unable to make it to the court date??
Email, letter, etc... Would like to show support but cant make the trip:frown:

What about the families that bought property because there was a snopark there? I know of three, and I would have bought property there if the price was right but they were asking too much, because of snopark location. Carpool sounds good.

I'm with 2thetop. I've been looking at cabins from Kachess to Cle Elum and proximity to snoparks is one of my highest criteria. If the riding area was closed I wouldn't be interested in a house near his at all. If he actually wins his house value will plummet.

better not snooze on this one sledheads or it will be gone. Please do whatever it takes to show up at this court date. i am letting a friend in the area know about it.

CONTACT your local politicians, they work for us and we pay their salaries.

Since we cannot afford attorneys, we need the polical backing. After all we pay for this land. Americans are stong enough to fight and win for what we believe in!

Hi Guys, new to the area. Had a chance to read through most of the documents last night. I'll be honest.......1) I've never been to the site 2) Have not once ridden in the area 3) Find this lawsuit completely rediculous. These people are a prime examples of NIMBY's.

Could a rep from SAWS or anyone else post contact information (names etc.) for local politicians in the area or an email contact where we can be heard. Letters are always good because they become part of the public record. I'm tied down at work on Monday morning and wont be able to attend the preliminary hearings but would love to have my voice heard.

Thank you,

DT

Please keep in mind that this is at a court house. This is not going to be an open forum where people get to give their input. Please remember to be respectful of the people and of the system. The only thing that we can do for this is to represent our numbers. That is all.
