yeap, the testing leaves way too much to be desired for legal inforcement.

That and I can't wait until some jagoff tries to ticket someone without an actual test. that ought to be interesting.
 
Yep. They changed it. Would you like me to scan the flyer that I received in the mail by State Parks? I am not making this chit up. What they told us when at the research sound check was that they were collecting data to see if changes needed to be made. Apparently adjustments were needed, hence the 96db limits. But as Mule stated, if given a ticket, there are enough holes in the testing that it cannot be 100% accurate, one could beat the ticket every time.

BTW, sounds like Johhny Law down in Gunnison is a classic azzlown! My sled is definitely not stock and it comes in WELL below the initial 89db limit!

Any device used in the state for a regulatory purpose (Fines, fees, measures) must be certified by the Colorado Dept. of Aggricuture. This counts for scales (Dope dosent count), radar, lidar (Laser), Intoxilyzer's and a whole host of other things. These must me certified yearly.

So.........do these "meter's" you speak of carry a certificate. You wouldent even need a laywer to get that ticket tossed !

I for one dont care for the really loud pipes.........but there has to be a reasonable middle ground
 
FYI.. I work with db meters a lot. They all read differently depending on temp, moisture in the air... blah blah blah.

The most important part tho is that 98 db is extremely loud!! I doubt there are very many sleds out there that are over that especially at only 4000 rpm's.

Also, is a rock band goes over 120 db for more than 15 minutes, they are fined big time. In fact, most states would allow everyone attending that concert to sue for lose of hearing. Most concert & drag races are 120- 130 at their peaks while maintaining a consistant 110 db.

I ride a '05 summit 800 ho, with an MBRP can. It was on the sled when I bought it, and it's not super super loud but it is not stock for sure and can be heard from a pretty good distance. Can anyone tell me if I have anything to worry about with noise level?
 
Sound Level

I have been wondering who is going pay for my belt when I do a 4000 rpm brake stand. I am not happy about that. Might have to start carrying a POS belt for tests.

Here's the law. Note the difference between OHVs and Snowmobiles; Also a licensed bike has a different standard -- new motorcycles and other licensed vehicles are 84. The 84 applies to all vehicles until the new law comes into play July 1. In actuallity, the Gunnison Law Mike is correct and the COHVA support for the new law got a new, louder standard passed.

Here's the new law

Colorado Revised Statutes:

25-12-110. Off-highway vehicles.

(1) An off-highway vehicle operated within the state shall not emit more
than the following level of sound when measured using SAE J1287:

(a) If manufactured before January 1, 1998 99 db(A);

(b) If manufactured on or after January 1, 1998 96 db(A).

(2) A snowmobile shall not emit more than the following level of sound
when measured using SAE J2567:

(a) If manufactured on or after July 1, 1972, and before July 2, 1975 90
db(A);

(b) If manufactured on or after July 2, 1975 88 db(A).

(3)(a) A person shall not sell or offer to sell a new off-highway vehicle
that emits a level of sound in excess of that prohibited by subsection (1)
of this section unless the off-highway vehicle complies with federal noise
emission standards. A person shall not sell or offer to sell a new
snowmobile that emits a level of sound in excess of that prohibited by
subsection (2) of this section unless the snowmobile complies with federal
noise emission standards.

(b) For the purposes of this section, a "new" snowmobile or off-highway
vehicle means a snowmobile or off-highway vehicle that has not been
transferred on a manufacturer's statement of origin and for which an
ownership registration card has not been submitted by the original owner to
the manufacturer.

(4) This section shall not apply to the following:

(a) A vehicle designed or modified for and used in closed-circuit,
off-highway vehicle competition facilities;

(b) An off-highway vehicle used in an emergency to search for or rescue a
person; and

(c) An off-highway vehicle while in use for agricultural purposes.

(5) A person who violates this section commits a class 2 petty offense
and, upon conviction thereof, shall be punished by a fine of not more than
one hundred dollars.

(6) No municipality or county may adopt an ordinance or resolution setting
noise standards for off-highway vehicles or snowmobiles that are more
restrictive than this section.

(7)(a) Nothing in this section shall be construed to modify the authority
granted in section 25-12-103.

(b) Nothing in this section shall be construed to authorize the test to
produce a less restrictive standard than the J1287 stationary sound test or
the J2567 stationary sound test published by SAE international or any
successor organization.

(8) The following shall be an affirmative defense to a violation under
this section if the off-highway vehicle or snowmobile:

(a) Was manufactured before January 1, 2005;

(b) Complied with federal and state law when purchased;

(c) Has not been modified from the manufacturer's original equipment
specifications or to exceed the sound limits imposed by subsection (1) or
(2) of this section; and

(d) Does not have a malfunctioning exhaust system.

So, if a sled is going to be tested at 4k RPM and this RPM doesn't come close to 98dB - what's the point of this law?

How many sleds sit there at 4k RPM? Once you hit 8250 RPM, I'm sure all of this testing is a moot point as the animals and XC skiers get really scared just the same.

Sounds to me like this is more a tool for harassment than a tool for controlling sound of operating vehicles.

BTW - another "Mike" story: So, I'm helping with the CSA registration trailer this fall, and had just paid the nice USFS lady my $$ for a sticker for one of my sleds. Miguel pulls up to the trailer and gets in my face (recall I am helping with the registration event) seeing that I don't have a USFS uniform on and asks if my sled is registered. I still have change and receipt in my helmet in the trailer at this point and am standing under the awning of the trailer with a package of hot-dogs in hand. Later said azzhat pokes his head into my enclosed trailer and says again: "are your sleds registered?" I politely reminded him that he already checked me. Then.. He sees my race sled in the trailer and was foaming at the mouth to write a ticket for it (sled is in trailer, skis off, 1/2 buried in coats and canvas covers), until I reminded him that that sled is for "closed course competition only" - he finally withdrew his fangs. After rambo walked off, I put the sticker I had just bought from the nice USFS lady on the race sled and whala! Butt nut. Later same day, he was very concerned/confused that i didn't have a headlight on my powder sled, and there was no tailflap. You'd think the USFS should just maintain and rent sleds and do away with private ownership of these vehicles (that's so YoBama!) /rant

Most USFS cops are major dikks! A badge and a gun and they will harass anybody and there is nothin gyou can do. CDOW is even worse!:mad::mad:

I'm just intrigued by our seemingly over-zealous local Eagle-Scout-project ticket writer. Chances are that he's reading this and looking up statues to nail me for "Unauthorized discussion of enforcement actions originating on USFS lands"

BTW - our USFS super-dude caries more than just a badge and a gun. He is equipped with a Tazer and a billy club while riding his sled. All to enforce $35 registration stickers! Maybe he should just mount a .50cal machine gun on the hood of the ol USFS Poo. One day we're going to hear that he lost a fight with a Mountain Lion, pissed his pants, forgot to change the batteries in the Tazer, shot himself in the foot and found the billy club chewed like a dog-toy.

Are you sure that "Mike" is not really "Danny" formally of the Routt NF. Your description of Mike is spot on to this Danny character we used to have here. :eek: All the way down to the billy club and sticking his nose in your trailer. I heard he moved to Delta a few years ago. We have a couple really good guys here now. IMO.

By the way thanks for your Irwin reports all season. I never made it south but enjoyed them all year.:beer;

Word is that he harassed a fellow on here for "illegal commercial filming" on USFS property without a permit while they were shooting two sleds riding in Cement Creek area. Apparently that is indeed a fine able offense, but it just seems like he's worked the "peace" out of "peace officer."

He's probably down on Elk Avenue (Main Street Crested Butte) looking for expired trailer tags - because he can.

LOL.

Rprecision - I'm sure you'll have "the pleasure" of meeting our fine fellow one of these days.
Just remember to dim the headlights (lowbeams) on your sled during the day - ticket!

So your in-favor of this new sound law? Who gives a chit how loud a sled is when you're in the backcountry. Seems to me that your beef is directed in the wrong direction.



New sound law for 2010. I just got this info in the mail today from Colorado State Parks

Any OHV made before 1998 must be at or under 99db
Any OHV made after 1998 must be at or under 96db

I have the SLP pipe setup with and HPS can and I had it measured. I measured at 83db and I haven't lost any horsepower because my sled isn't loud. Imagine that.
