Specifcially the 5th, 6th and 14th Amendments

No person shall be ... deprived of life, liberty, or property, without due process of law

So due process of the law would mean they cannot be deprived specifically of liberty (freedom) without the process of the law, meaning a trial.

The 5th Amendment guarantees due process for the FEDERAL Government, and the 14th for State Governments.

Okay first of all I am not an American. I am a Canadian. I relize what your contitution says about being a US citizen etc and them not and it being a war. I was in no way saying that they should release the prisoners of Gitimo into the US thats crazy If the Canadian government did such a thing I would be the first to protest.

You brought up the 14th Amendment Jail House so I explained it to you! No the Supreme Court CANNOT ratify or amend the Constitution! They can make a decision and that makes it CASE LAW. The Constitution (capitalized because I have respect for it) applies to US citizens and it does apply to people within our borders that are not citizens if they have been charged with a crime (yes they are given due process). No that does not give illegal aliens the right to stay in our country until they have had a trial....since I think you might bring up that argument again Jail House. Guantanamo Bay is Cuban Sovereign soil that is leased to the United States Government. It is a Naval Station.

Obviously if that lease makes it subject to US law for non US citizens is still being debated by lawyers and scholars way smarter than me.
