June 15, 2004--The International Snowmobile Manufacturing Association (ISMA) announced today that they filed briefs with Wyoming District Court supporting a permanent injunction of the Record of Decision (ROD) filed in 2000 intended to prevent snowmobiling in Yellowstone National Park.
The briefs included the following points, according to a press release from ISMA:
1. The ROD failed to take a hard look at research and analysis of snowmobile use in the parks. The Administration reversed the former preferred alternative and did not consider any public comments.
2. From 1998-2000, the Park Service violated the Administrative procedure Act while conducting the Environmental Impact Study (EIS) by failing to base decisions on long established National Park Service Policy.
3. The NPS misapplied the NPS Organic Act by failing the balance the dual conservation and public enjoyment mandate.
According to the ISMA, Judge Brimmer is scheduled to hear arguments to allow snowmobiling in Yellowstone starting August 20, 2004, with a ruling expected this fall. More information about the debate about snowmobiling in Yellowstone is available at the ISMA's Web site,
