I did that to a bird one time when I was 15.
I was down in the BigHole Valley, between Wisdom and Jackson, MT.
I was in the yard in the morning before we loaded up to head to the hay fields (I was on a mowing crew for the Dick Hirschey Ranch) and we all saw this bird fly over the top of our heads. It was like a curlew or a snipe or something. It had a long skinny curved pencil beak.
He landed over a muddy ditch bed over a bank about 30 or 40 yards away. I picked up a rock about the size of my fist and lobbed it over this bank. Sort of like a cross between a shotput throw and a grenade huck, LOL. The bird never flew. My buddy Jason and I looked at each other, turned and looked at the bank, and broke out into a sprint to see the bird. When we looked over the bank, the rock was embedded into the mud about 6", and sticking out around beside it were wings and feet. I hit that sum bich squarely in the head and killed instantly. I could NOT believe it, and would never have believed anyone had they told me they had done it themselves. LOL
They didn't have digital cameras back in '88, but that would have been one to get a picture of. I was astonished.

I got one last year while playing golf, I was on the tee box and hit a low screamer down the fair way, it was only about 2 feet off the ground, the ball went up over a small rise, then Poof nothing but feathers, there was a robin standing in the wrong spot at the wrong time.
Best part about it was I went on to birdie the hole to. We have since named it the double birdie hole.

My wife was golfing for the first time ever up at Banff on the resort course. She's on the tee box and there's a cow elk at 100 yards out, broadside.
She says "what if I hit it?"
Judging from how the day had been going so far, I said, "Nah, you're never going to hit her."
She takes a whack...the ball skulls off the tee box low and fast and bounces about 10 feet in front of the cow. Hit her right in the gut. LOL. I guess all I had to do was tell her she'd never do it. HAHA. Got that on video too, I think.

That's why the announcers always are whispering, they don't want to wake everyone up. I don't mind playing ,but it's boring as heck to watch. I love to fish too boy there is some excitement to watch.

Its one thing if he didn't see the bird and acidentaly hit and killed it.
But he was aiming "at the tree" to try and scare it and ended up hitting and killing the bird.
He deserves to pay the fine and spend time in jail! IMO
