Need input on motor issue

I know a lot of folks have dealt with cranks and pistons on the Poo 800 motors for a while so I will use that to start and put on a little twist for ya. All opinions acceptable.

Long story, kinda shorter........
My buddy bought an '04 Escape from a guy in N. Utah this spring. Sled appeared to be in good shape for the year. Talk n talk, yadayada between him and my buddy about everything. Sellers selling point was that he had the crank go out and had a shop replace it with a new one with the 'tough-guy' bearing kit. He also replaced the pistons himself after that as 'part of an annual maintenance regimen he does every year...' Seller claims he rode it a week before my buddy took a look at it and everything ran 'great'.

So......... my buddy takes delivery in early April. Due to my schedule we don't do riding until late april down in Preston. Conditions were perfect, temps in the 20's, good snow, sunshine, let the sleds warm up, took off down the trail. Get up to a meadow after about 5 miles and start boondockin around. Didn't see him follow, so turned around and found him sitting in the flats. He says it's been running like crap and finally just started boggin out til it quit. I go to pull it over and NOTHING.. Seized up like a mofo. Open the hood, start pulling plugs, try to turn the clutch, all the normal 'WTF happened' things you look for (i guess). Get it to finally pull over, but it's definitely not smooth. Main thing we noticed and concluded had to be the culprit was the case oil line had not been clamped on tightly between the clutch and case and had come off and melted in the process. Obviously for some amount of time before or during that 5 miles that line had come off. The little clamp wasn't even hard to put back on with bare hands.

Decide to tow it back and head home. He finally got a shop to tear it down last week, and they told him most likely the pistons and crank would need replaced to the tune of around $1k. Does anyone think my buddy has a chance at going at this guy for anything or is he going to have to eat this repair?? (I can go both ways, but I think whoever put it back together did not check everything good enough). Here are some facts.

1. Buddy gave seller cash, but did not have a bill of sale filled out.
2. Seller doesn't even have the title to give to my buddy because seller before him didn't have the title in his name. (HUGE red flag IMO, but I wasn't there when all this went down.)
3. Buddy took 1 1/2 months to get it to a frikkin shop just to figure out what was wrong, and still hasn't called seller to talk about only getting 5 miles out of the deal.
4. No other agreements made except 'here's the sled....ok, here's the money' to support an argument about who should take care of the issue.

Anyone think there's a chance of my buddy getting anything out of this guy, or is he sunk in the mud for not covering his butt on the deal????? I have my doubts especially where it took him so long just to figure out what went wrong. Sorry about the novel, opinions are welcome and appreciated.

Not a chance in he11. Look at it from the seller's standpoint... he had the sled go away 3 months ago and then your buddy calls now and says, "Hey you sold me junk" or whatever. If I was the seller I would laugh at him.

If the PTO oil line was disconnected then worst case is that the big bearing and inner bearing are shot. I would be surprised if that hurt the piston, but stranger things have happened, but it should not have affected the mag side piston.

And it wouldn't be surprising if the case was damaged (bearing spun in the case).

But no, I don't think he has any chance of going back to the seller.

And you are right... no title should have been a deal breaker.

Yeah if I was the seller I would laugh to. It's been 3 months since he bought the sled and then he never got a title? smells fishy. Luckily it's winter and you have all summer to get the parts that went down in the motor bought and put back together before snow flies. sucks for your friend but this sport can get spendy.
 
I wouldnt even talk to the seller about it.. It seems liker a bum deal for your friend, but if it were me I would just chalk it up as lesson learned and either part the sled out or fix it myself to save some $$ on the repairs..Thats a bummer though.. Always bad to hear a story like this.. I know how it would make me feel..:pout:
 
For what its worth, your buddy may want to make the investment and let the local police look up the serial number on the sled to make sure its not a (HOT SLED). then if it is he can go back to the seller and get him to restate that he sold it to your buddy in the first place, so you may be able to make a case against him for selling stolen property, (knowing or not). going to the cops might make things hairy for your buddy but if he's honest with them and things are a bad deal here, they might be able to help him get some of his money back. hope this helps. just my 2 cents. if he got screwed then take someone with you.
 
Funny thing is, my buddy is a cop^^^. He could probably figure out whether or not it's stolen, but I doubt he would really dig into it that much. He's more of a procrastinator than I am, and that is bad. His first problem is he's not too savvy when it comes to knowing what to look out for in a sled. I didn't even know he had bought it until he told me to come over and take a look. Once he started devulging all the deals from the sale I gave hime the 'DUDE, are you serious?!?' look when he said the guy didn't even have a title. I really pushed him to get things taken care of back when it happened, but from the responses here I get the feeling that my hunch about being SOL is probably true. Thanks for the input, keep it coming if you'd like.

I would run the numbers on it to see if it is a legal ownership or not prior to dumping any more money into it. If by chance it gets repo'd, no point in having your money into the motor too.
