Legal Question - Public Intox

This is going to be fairly long, but I want to describe the whole ordeal. I am just looking for a few opinions. I will be contacting a lawyer that is a family friend to see if I actually have a case, but I like seeing others' experiences and opinions.

Let me set the stage. I attended a rather large motorcycle rally (25,000 people was estimated) over the weekend. A couple of friends and I went to a restaurant around 8 pm and I had one 22oz. coors light. We then went to the rally around 10 or so. There was a concert that night, and during the concert I had another 16oz. coors light (just one). After the concert we went to a bar where I had 2 or 3 more beers. When the bars closed at 2am, we all went outside. As we walked outside, I watched the police literally tackle a guy and cuff him. I am a real happy go lucky guy that doesn't take to many things seriously, so just as a joke I started skipping down the street behind the police as they lead this guy to the car. All of a sudden I hear "you think that's f'in funny?", and next thing I know I am being bullrushed by 3 cops. They slam my head into the concrete, and cuff me. As my face is being rubbed in the asphalt, it is natural instinct to want to put my hands down to lift my body off the ground so that my head isn't being dismantled by the cement. As I am trying to put my hands out, all I hear is "quit your resisting," so my next thought is "oh great, now they are going to nail me with resisting too." I go limp and just let them do their thing. They take me to detox where they ticket me with public intox.

I never received a ticket, but when my gf bailed me out, they gave her a receipt saying that i had been bailed out, and that I had a court date set in a couple of weeks. I did no field sobriety tests and no breathalyzer (although I gave them permission to do one). I have a fairly decent tolerance to beer, and 4 or 5 beers in 5 hours does nothing to me. I felt completely sober and was just looking for a laugh (yes, i know it was still stupid). I now have a large abrasion on my face, a black eye, and a fairly large bump on my forehead. First off, do I have a case to get off of this public intox? Seems pretty open and shut to me, but don't want to pay a lawyer if it is not worth it. If the cop would have simply said "hey, you better quit that!", i would have stopped immediately. Do you think that tackling me without at least a warning was a little aggressive? I have 3 or 4 witnesses that will back me all day, but it will be their word against the cop's word, and we all know how that typically works out. Just looking for a few opinions. Thanks in advance.
 
Basically you caused this to happen, drunk or not. if you would have kept to your self none of it would have happened.It sounds by your story that you tried to interfere and obviously did. Save your money i doubt you could win anything. This is based off your story and thats all we know is your story.
 
Don't know the answer to your legal dilemma but your story convinces me never to ride to or through Nebraska.:face-icon-small-sho
 
Even if you found a contingency lawyer,you would have a hard time beating the state.The cops would just say you were interfering with an arrest and then they would say you resisted as they already have.Even with video evidence nowdays you still would be in the 2% that actually would win a case like this.I would pay the fine and remember to not do anything like that again when I'm drinking.JMO:wine:
 
After getting arrested for a DUI (I wasn't even old enough to drink & had a point 162 blood alcohol). I was advised by a lawyer to go to your first court appearence and essentially see what happens, you do not plead anything and tell the DA that you seeking counsel. The next court appearence the lawyer comes with you and does all the talking. I got my DUI deferred with a little community service. Best money I ever spent. The initial consultation with the lawyer is probably free and a local lawyer's opinion is worth far more than anybody's here. My situation was in CO, things may turn out different for you...

Good luck, stay away from the court system, it seems to be a never ending black hole once they get your name...
 
One thing you need to remember is that the officer(s) involved were reacting to not knowing what your intentions were. They don't want to be involved in a situation where their saftey is in jepordy. Their making to the end of their shift unharmed depends on controlling the situation and being ready to react if something changes. Not that you were going to do anything to hurt them, they were just doing their job.

I say be glad you only got a public intoxication charge, learn from it, and don't let it happen again.
 
Sorry to hear that. However you went out of your way to have a run in with a COP shame on you lol. avoid those F@@@ERS like a prostitute with hiv, as soon as that uniform goes on nothing good comes of it thats a FACT!!
 
Call the court and see if it's payable without appearing. If it's just a fine your looking at a petty misdemeanor and it's not going to do anything more than a speeding ticket. Obviously you may be able to get it dismissed if you appear and such, but it depends on how much time and effort you want to put into it.
 
If it is just for public intox, it doesn't matter what else you were doing. Did they cite you with anything else?
If not, they have to prove you were intoxicated. Can they prove this?
 
Unless the law has changed in Iowa they do not have to give you a breathalyzer test to issue you a citation for public intox. If it is a city ordinance ticket just pay the fine and move on.

This is probably the best advice. Guilty or innocent will be a pretty small detail. If you want to fight it get a lawyer, he will try to get the video evidence. If all of a sudden there isn't any that will give you a pretty good clue on how the rest of your battle will go.
In the future no matter of good, bad or indifferent avoid them like the plague and teach others to do the same. Dam good lesson isn't it.
