For those of you that are serving on the board of a gun club or have!

If a shooter came to your club with a gun with intentions of shooting, and was found to be or known to be a felon, what would your responsibility be. Should it be brought up and dealt with and if so, how should it be dealt with ??


Should the directors ignore it and allow life to go on?

Should the directors do due diligence and make a informed decision? keep in mind known knowledge may make a liability.

Should the directors be simply black and white and ask him to leave?





I have a opinion on this but am going to refrain from my reply until I see what the pulse of this forum will be.
 
Not knowing all the circumstances, but it is pretty much black and white. IMO you would be obligated to follow the law to the best of your ability, wether you agree with it or not! Also, ignoring an issue is NOT the answer, if one is in a position who can not make crucial leadership decisions, then maybe it would be time to let someone who can? Not saying this is you, just speaking generally based on the majority of our political leadership from the local level up!
 
Along with the leadership or board position comes along the ugly sidekick known as responsibility ..you know that personal responsibility thing, your responsible personnally for everyone else.
Yeah it is infered at some level that what if something were to happen and you knew beforehand???? CYA just in case some one wants to cover thiers first and it ends up in court etc etc .

He's not locked up in prison, he may be a felon, but i consider him a free man. The second amendment is a right to all free men. I dont agree with automatic loss of 2A rights due to a felony. The loss of 2A rights due to a felony needs to be changed i believe. To more of a 2nd chance/type of offense deal. Id leave it be, avoid conflict and let him create his own downfall. All of those laws are just in place to start withering down citizen ownership. Taking away his firearms, wont stop violent behavior with a weapon, he's got thousands of options. Its up to him to control that.

How can we convict someone, let them serve their time, pay their fines, then say, ok youre free to try again, but oh yea... You can no longer defend yourself.


Very touchy subject! It has its benefits for society, but needs revamped...


At a private club situation, simple, don't allow felons membership. Charge $10 to run a background with application. This will keep you free from running into conflicts that may bite whoever has to bear the bad news.
 
I agree the law is the law but I would like to know what crime he committed. The crime would be the tipping point for me.
I work with 2 guys with felonies and their crimes seemed( to me ) not worthy of the penalty.
How long ago was he convicted? After so many years he can hire a lawyer go back to court and get it lifted from his name.
 
I personally agree with XC, that being said the sheriff and I would imagine the ATF will be involved if this comes to there attention will have a different view on this. I would hate to bring unwanted or unnecessary attention to my gun club. A guy I went to high school is serving 26 months in Leavenworth USP for felon in possession of a firearm. He was on probation, they came and did a home inspection and found his hunting guns (he was a good kid just got messed up with meth) and now he's sitting down there. That is a law I would not want to mess around with.
 
Felon for what would be my first question.

Felon for a crime involving a gun and/or violence - black and white - shouldn't even have a gun period. Don't care if he has paid his dues or whatever. Might be within his rights....but if he is at a higher than average risk of endangering others, doesn't fly. The potential rights of one should not pose a threat to the potential safety of many....

That said, lots of places you could be a felon for have 4 beers after work and getting pinched at a checkstop. In that case, I can't see that person having anymore threat than your average person. Chances are, most other members have done stuff like that....just haven't been caught.
 
If your bylaws, membership or Insurance state "Legally able to posses a firearm to use the facility's" you don't have much of a choice.


If the above does not apply, it would depend on his "Felony" for my decision.
 
Assuming the felon is my Ex-wife, I ask that you shoot her first, let God sort it out. She kidnapped my kid and fled the country, the RCMP finally pulled her over and sorted thru her aliases and returned my daughter to me. Ex served a year in jail and is out now, freer than we are. Stalking us and trying to regain custody. Their is no Justice left in our Justice system, just a bunch of politically correct pansies for Judges these days.

Sorry for the rant, I'm just on the other side of the fence and the title of the post got me spun up.

If the felon was for a gun related issue I would say they should never be allowed to get a holf of a gun again. It is like an ugly woman. You can put make up over it, but you can never change how she really looks.

And as far as the guy's felony charge, i highly doubt its firearms related. I bet only 5-10% of felons, have firearms convictions. He probably has 12 overdue parking tickets or something ....
 
If I'm on the board and I know the one of the shooters is a felon, I kindly but straight forwardly ask him to leave. If necessary I would explain it's about the club and nothing personal. If he can have it removed or have his gun rights recovered, I would encourage him to do so and ask that he bring in the appropriate paperwork, so we can welcome him back in the future. plain, simple... no bs.


While I don't necessarily agree that all felons should lose their rights for a great many of offenses, there are others that have absolutely no business having access to a gun. I would not ask or care to even discuss that crimes were involved. Again... not my position to judge, enforce or nark. Just too protect my organization and wish them well with their situation.

It really doesn't matter what the felony is, the state of Nebraska has a law prohibiting it as does the United States 18 USC 922(g). Again I don't necessarily agree with the law, the guy could of got his 4th DUI or embezzled money, that doesn't make him a violent offender.
I wouldn't want to have to answer questions to the Sheriff, federal marshals or ATF agents if or when they start an investigation on why is your gun club is allowing felons to be members. But that's just me I don't like attention, especially by federal agencies.

He owned a car dealership and had got in financial trouble on his floor plan so he had floored some trucks that were not on the lot anymore. ie, double financed between his operating credit and a auction credit institution. He is a well known business man and a former state champion shooter. His family has been the foundation of setting up our states current high school shooting program, so much so they host a shoot in his name annually that brings 800 shooters to the event.

In all fairness for you "black and white" guys I can only say. Do YOU know anyone personally that has a felony and prohibited from such things? and if so do you KNOW what they did?

I agree with others that say you should take it case by case as there are A LOT of different reasons for a felony. Most of us are not familiar and generalize a felony with robbing a bank, drug dealing,rape, aggravated assault things like that.

I know I have a responsibility to the club but it is a tough call when I read things like this...What about the guy just this week jailed and charged for plugging his hybrid into the middle school? or the guy that wrote a bad check for more than 500.00 for a boat with a bad motor and stopped payment, or the dad that broke up two teens fighting and ended up entangled in the fight defending himself???? The lady that ran her sprinkler during a drought and the law said only to use them on Monday or FRidays???? SERIOUSLY a FELONY!! or the DUI guy that is your best friend and a shooter on your squad??? REALLY?? REALLY?? these guys should be on the same level as a rapist, bank robber and be judged by you "black and white" guys that are taking it as your responsibility to enforce there penalty??

I know the law is the law but we have a government/ president that will not even follow there own laws and yet they expect the people to hold to a higher standard. Putting low level crimes into "felony" seems like a back door way to dis-arm Americans. I just do not feel I want to help enforce that.

IMO, unless you are charged with real authority like a ATF or police you should stay out of it.

At the risk of asking a dumb qustion..can a felon own a gun? And if no; is there really anything saying a felon can't shoot a gun?

And if a person is ever convicted of a felony, and they own guns at the time of the conviction; is that felon supposed to turn in his/her guns? Like that would happen, turning in your guns.
 
Felons are not to possess firearms. Cant have em in their home, cant hold em, cant shoot em...
