Irrigation Ditch

Question for all farmers. I have a irrigation ditch that runs through a piece of property that I own. The property is Zoned commercial, in the city limits where I have city water and sewer, and I do not have any water rights from this ditch. I have always made sure that the ditch is clean on my property before they ever turn the water on in the spring. But because they cannot access the ditch above or below me, (because of willows) they always wait until the crap that floats down gets to me, where they can get to it, and throw it up on the bank, and there it sits until I clean it up. I'm sick of it, two of the farmers on the ditch are nice guys, the other two are a--holes. I have jumped them about it repeatedly, and they tell me they have ten feet on either side of the ditch, and I am lucky they are letting me use it. I have looked for this law, asked them to show me something on paper that says anything like that, they can't. I know I have to grant them access to their ditch, but this is bull----. What are the laws? Or do I have to keep throwing their crap back in the ditch.
 
i would say that they have an easment to use the prop but i don't think that they have the right leave garbage on your prop. after all it's still your prop. i would call the sheriff next time.
 
Yes, you have to grant them access to clean and maintain they're waterway, but no it is not their right to throw all the dirt and or debris up on your property, BLU DU is right, a sheriff call with a littering complaint would be appropriate.
 
Check your state and local laws, a lot of men have been killed over water rights.

IMO, since your land is zoned commercial I would say put culvert in the whole length of your property with a debris grate on the upstream end and let it collect on their land instead of yours. Of course, the problem with that being the monetary investment.
 
There will be a easment to access and maintain the ditch.

As far as the farmers, they are just being lazy. It is nothing a 1/2 gallon of gas and a match would not fix.

I would not put culvert in. The ditch seeps, technically, due to this seep, you are getting a bit of free water. Although, I would not maintain their ditch for them, let them do it. If it blows out, send them a bill to clean up the mess. Bottom line, if they want their water, they will have to maintain it.

If you continue to clean up their messes. I would send them a bill. If they do not pay, charge them a late fee and interest.

Do it, once the crap builds up to where the water stops flowing they will care. Or just damn it up and get your gun.
