I don't get it???

Unless there is more to the story than I am understanding.....
There was no malicious intent.
This won't sound popular, but if you can get off for temporary insanity (which
is usually a crock)
then why can't you get off for temporary stupidity? (which seems genuine in this case)

So if I drink too much on New Years and get in a wreck killing someone, can i plead temporary stupidity?

If I am texting on my i-phone and run a stop light and kill someone on the crosswalk, can i plead temporary stupidity?

Stupidity and ignorance are no excuse for poor judgement, which I feel is a form of malice.

1st I am not defending his actions, I agree that his actions directly resulted in that little girls loss of life.:(

2nd I believe your first scenario would result in homocide charges, not murder
The second scenario may get a careless driving, not murder.
 
what kinda a idiot is out drivin around in a blizzard with kids anywhoo ..........bad deal and whats done is done .........-30 cut off for us we won't even go to town till it warms up ..let alone a storm

and if we do everyone is in snow pants and snow suits....blankets in the van..big boots on etc etc

The charges of the two scenarios is beside the point. I feel that using temporary stupidity to excuse assinine decissions and that it in any case could be used as a viable defense is ridiculous

I have a weak spot for kids, any crime involving kids the punishment should be automatically quadrupled.

After Ingram noted that second-degree murder carries a maximum penalty of life in prison, Aragon said "Oh my God" as he banged his head on the table one final time.

I dunno, seems to me he's more worried about his possible punishment than the daughter he just killed.

Who has a reasonable exptation that an 11 year old girl is going to walk 1o miles in knee deep snow???? NO ONE!!! This is cleary MUDER!

not only did he let them start walking in a snowstorm...........the HUGE thing was he felt it unneccesary to go get them after he was unstuck..........I mean who does that?...

I cant even imagine letting my 11 yr old out of the car to go on a 10 mile hike down the highway in GOOD weather.........are you kidding me????

This guy deserves what he gets...........he has no respect or love for these kids or he would have been out of his mind trying to find them right away.........they wouldnt have been out of the car in the first place.......

I cant.......I dont know..........really? I cant even describe how angry this makes me.........those poor kids.............

I am not making myself clear. Sorry for that.
I was making a point mocking the temp insanity loophole in our legal system.
I was pointing out that far worse people have gotten off with far worse offenses by simply manipulating a single jurer into that temp insanity loophole trap.

I cannot imagine a scenario where I would advocate a lesser penalty for this guy.
However, I will not jump on the "send him to the chair" bandwagon without knowing all of the details.
 
How is a murder charge NOT warranted in this instance?

His obvious disregard for his own children resulted in the death of his young daughter. His actions resulted in her death.

This isn't a hard decision. I say light him up.
 
All emotion and knee jerk conclusions aside, murder is an act of intent.
I guess if they can prove he had the intent to kill her in the first place, which we don't know, they could charge him with murder one.

This is clearly child abuse resulting in death. He should be, as someone said, tied to a fence post in his undies in -40! :(
 
Where was this guys common sense? I mean really who lets there kids walk 10 miles in a blizzard. This guy had no right to even have custody of those kids. Sad story.
 
By allowing these morons to raise children, we are setting them up to fail.
Then when the fail, we sit on the sidelines cheering as their punishment is handed down?
It's saddening.

This crap shouldn't surprise any of us!
If we let idiots raise children, expect them to make idiotic choices!

Somehow, if the same scenario was a woman instead of a man I doubt that she would be charged with anything. In fact, I believe that is just what happened last year when it suddenly became popular to cook your kids in the car during hot weather.
