***HELP!!! where to find the rules of the road for MT?***

hey guys,
im headin to court to try and get money that a guy owes me for hitting me and i need to know what the rules of the trail are. i have looked all over the internet but i can not find a website that have the rules of the road for snowmobiling in MT. if anyone could help me out that would be great!

I don't know where to find them...but I will see if I can help.
I have a few buddies who are city policeman, county deputies, and one buddy who is an HP.

I do know that if you are attempting to overtake someone (PASSING them) you yield to them.

I just sent my buddy Derek a text about them...I'll forward it to you as soon as I get a reply.
 
the papers i got from the judge said i will be questioned on the laws pretaining to my case so i figured i better know my **** before i go in lol
 
Yes, be preapred. Know your stuff inside and out cause attorneys and judges will grill and test you and try to trip you up.
 
The lug nut rule

In Montana it's called the "Lug nut rule". He who has the most lug nuts has the right of way.
 
this could really help me or it could hurt me since i was playing on the bank all day and at the time of the accident i was turning off the right side of the trail to hit the bank again.
23-2-654. Snowmobiler's assumption of responsibility -- duties. (1) A snowmobiler shall operate a snowmobile at all times in a manner that avoids injury to self and others and must be aware of the inherent risks in the sport of snowmobiling. (2) A snowmobiler shall:
(a) know the range of the snowmobiler's ability and snowmobile safely within the limits of that ability and the snowmobiler's equipment so as to negotiate any section of terrain or snowmobile trail safely and without injury or damage. A snowmobiler must be aware that the snowmobiler's ability may vary because of terrain or trail changes caused by weather, grooming changes, or snowmobile use.
(b) maintain control of speed and course at all times while snowmobiling so as to prevent injury to self and others;
(c) heed all posted warnings; and
(d) refrain from acting in a manner that may cause or contribute to the injury of anyone.
(3) A snowmobiler shall accept all legal responsibility for injury or damage of any kind to the extent that the injury or damage results from risks inherent in the sport of snowmobiling. Risks inherent in the sport of snowmobiling are:
(a) variations in terrain, including surface or subsurface snow or ice conditions naturally occurring or resulting from weather changes, snowmobile use, or grooming or snowmaking operations;
(b) bare spots or thin snow cover caused by limited snowfall, melting, wind erosion, snowmobile action, grooming, or unconsolidated base;
(c) rocks, trees, or other forms of forest growth or debris;
(d) clearly visible or plainly marked improvements or trail maintenance equipment; and
(e) avalanches.
(4) The provisions of this section do not affect a products liability cause of action based upon the design or manufacture of snowmobile equipment or products or safety equipment used incidental to the operation of a snowmobile.
 
Like I said though...if he's going to try to pass he is assuming and accepting responsibility for the action.
 
maybe i'm wrong but suing someone for an accident im sure they didn't intentionaly want to damage your sled, chalk it up to being at the wrong spot at the wrong time. i personaly think todays society is to sue happy and nobody wants to take responsiblity for there own actions, the great thing about sledding is the freedom it gives us and for the most part being away from all the rules and regs of other everyday living
 
well for one i am not a sue happy person and i never will be. i hate those kind of people. put it this way. if someone ran a stop sign and t-boned your truck would you want them to pay for it? my guess is yes, you probably wouldnt go oh well....wrong place wrong time. it was the dudes fault and he said he would pay and signed a written contract sayin he would and now that it is time to pay up hes backin out. that is why i am takin him to court. and it would have been taken to small claims but you cant if it involves damaged property so that is why i filed a civil law suit. ya he didnt intentionally hit me but he was fu*&in off and did almost $1500 in damages. it was his fault and he admitted to it and said he would pay for it....i am just collecting what he owes me. i dont know about you but i saure as hell cant take that kind of hit to the wallet and blow it off.
 
can't beleive the guys signs off to pay for it then doesn't, he needs to get kicked by the court, if you say your goin to take care of it then don't your scum in my book
 
I know the rules, but I am afraid to post them up in case I am wrong....would hate for you to sue me or something :eek: ;) :beer;

i will. i am suposed to go in tomorrow for a pre-trial deal to see if the guy will settle out of court. the real pisser is that i have to drive 160 miles to go for a 15 min. meeting. oh well ill get to go soo some good friends though!
