50 MPH crash...my 3 year olds child seat worked!!

This could be an up hill battle.

Yes it could be, my buddy's accident took nearly 8 months to get sorted out. After all the jockeying the lawyers, him and the ins. guys sat down at the table with some pictures and they were singing a different tune in about 5 minutes. Don't let them bully you. Document everything you can with pics and video. As a body shop guy I'm sure you've heard the good and bad stories of this type of stuff.

Good luck and best wishes to the wifey's recovery.

Geeez Tim  Glad everyone is going to be okay.

I've done the same, let the kids ride in front, it's just not worth the "quick trip" to the store.

The insurance already called us today and has offered us 1000 dollars to settle if we sign now.

Ummmm, NOT!!

I'm not one for frivolous lawsuits, but come on :face-icon-small-fro Seriously??

Guy I work with is still battling injuries from an accident 3 months ago, got his back all screwed up and it's been a long road for him. Sounds like your family got lucky, but not lucky enough to settle for 1k. Good luck to your wife on the recovery.

good luck

well himark hope everything turns out in your favor. oh and im glad somebody gave me a red dot for caring about somebody;s family (real cool) good luck himark

Glad everyong is ok!

Make sure you document everything including the phone calls with the insurance companies. If it turns out you have to go forward with a suit, it's a lot easier when you have everything documented.

Holy crap, Tim -- just saw this...

She is a cutie, must take after her mother!:p

I hope everything turns out well.

Geez when the insurance Co calls and offers u a 1000.00 to settle....... what's that tell ya?

Himark:

Glad everyone is ok.

Last summer I had a similar thing happen, but an 85 year old lady pulled out of a side street and we hit her right in her drivers door at 55mph. Kids both strapped in the back seat, youngest with a car seat, and they both walked away. They were sore for few days, but no lasting issues.

Just a FYI, I would get your daughter to a chiropractor ASAP and have them do a full set of xrays. Our kids had some misalignment due to this and after a few weeks of adjustments, that misalignment went away. Oddly enough, when you are in a crash and need medical treatment, YOUR policy pays the first "X" amount. I think the minimum amount anyone has is like $25,000

The clock starts ticking for the insurance company the moment the accident is reported to them. They will try and have you sign a release that states that your daughter is ok, and the insurance company will no longer pay any medial bills after that. It would be a shame that this crash caused something undetected to rear its ugly head 2 years from now.

Get to the chiropractor ASAFP and bring your claim # and insurance company info. The chiropractor will directly bill the insurance company. Believe me it is worth doing........

You will have a lot more bargining power with the insurance company once you get to the chiropractor and they find her spine out of alignment.

$1,000 is nothing, our insurance company pyed for all doctor and chiropractor visits, and we ended up settling for much more per person than $1,000. We have that money set aside for awhile to make sure nothing is wrong with the kids that we would have to pay out of pocket for.......

Glad there were no serious injuries.

Don't settle too quickly. Find out what the state claims statute of limitations is. I believe it is at least a few years, maybe up to 4 years. Like previously stated, some injuries don't become evident till months (maybe longer?) after the accident.

Ditto on the attorney - would probably be a good idea.

Is the TDI going to pull through or is it toast?

Glad to hear your daughter was strapped in and mom is doing well. I met a gal at seminar once and she was describing her accident to me. Airbags deployed and she described it as a 200mph punch in the face. I can't imagine, but that would be better than the alternative.

As others have said, don't settle and get everyone (daughter) looked at. How did the teenage girl turn out? She ok?

Hope your wife heals up soon and is okay. Tell her not to rush anything.

Cadman
The ole Jetta is going to goto the rebuilder list. I built the car originally hit almost same damage but other side. Not quite as hard because it didnt have the buckles in the roof the first time. We are heading out Oct 3rd to fly down to Atlanta to pick her up a 05 Passat TDI. Those damnnn cars hold there value and that is what i am arguing with the auto apprasier now. He keeps telling me "book this book that" I keep telling him throw the book away and go look at market prices on the Tdi's.

I have not heard back from the insurance since there initial offer and the wife has had 2 PT spine alignment sessions so we are starting to think we should get my daughter looked at also. Thanks for all the great advice here.. This forum is full of tons of experience in most all incidences.

Those both must be very solid cars if that was [nearly] head on at 55!

I would have guessed more like 40.

Give 'em both a kiss tonight Himark. Super glad that their ok. After cutting a few out on the fire dept one realizes the importance of proper restraints.
Kinda makes a guy realize what's really important in life and how much a split second can change the rest of your life doesn't it?
