Need advice about a PayPal/eBay problem

Thanks for all the replies. Since this has happened, I won't take anything but a money order or cashiers check on high dollar stuff that I sell on eBay. I would like to post the azzholes name and stuff but I don't know if I should because of the possibility that this will probably end up in court. And yes, I do have pictures of the serial numbers.

If it was me, I would take it to a lawyer...I believe most states require a defendent to appear where case is filed..so by having a lawyer file small claims for you where you live the defendant(s) will have to appear there...also you should be able to ask for your lawyer fee's as well...I wouldnt ignore it cause it may come back to haunt you down the road..and then you will look guilty...

Yeah, I know. But that's what happens when you get married to a cop. She won't let me do that stuff anymore. Almost makes me have an angxiety attack sometimes. LOL!

What I'd really like to do is rent an airplane or a helicopter, fly over the guys house, and give THIS motor back to him from about 1000 feet.

I buy & sell on Ebay, with years of experience. Something just doesn't add up here but that's just me. It's not likely that the buyer is a crooked Ebayer...it's real hard to make money when you pay for the goods you bought. It would be nice to hear the other side of the story.
The fact that Ebay is asking you for money likely means that they have examined the listing, the correspondence & investigated the buyers claim & have reimbursed him under their buyer protection policy. You provided them your side of the story & info on the engine switch yet they still paid him??? Just doesn't add up since getting money out of Ebay on a buyer claim is not easy. They don't refund to buyers without a little blood and are in the business of dealing with crooks. Not to say that they couldn't make a mistake but you have to wonder!
Selling merchandise "as is" still has limitations. You must represent the condition of the merchandise & normally do describe it in your listing. If there was any thing wrong with the motor & you failed to disclose then you can't hide behind the "as is" representation. Consumer protection laws, State & Federal cover this under implied warranty. A customer has a right to expect merchandise in good working order unless otherwise represented in writing-that's the basis behind implied warranty.
If he sent you his old blown motor then he was obviously wrong, crooked, whatever. Probably got partial reimbursement from Ebay & kept your other motor to recoup his losses.
In most cases like this the seller refunds the money less shipping & handling charges. With an engine that's a big hit for the buyer since he pays freight both ways. The seller refunds only after satisfactory return of the merchandise, so no risk to the seller. You chose not to do that maybe because of the great price?
I'm just saying that the buyer acted in good faith initially since he needed a motor & sent cash through PayPal. What was said in the listing, the condition of the engine, the buyers side of the story, leave reason for questions in my mind.
 
He's gonna forget all about the .50 when he jumps on a .338 or .375 Cheytac :) god help us all.....
 
send him good conterfit 100 bills...then inform his local police that he is a conterfiter..why should he get the same money back when he didn,t send the same engine..

I have been selling on Ebay since 1998. Pushing ten years and sold over 10,000 items.

I have seen quite a few disputes and in EVERY dispute with a buyer I was found to be wrong as the seller. Even with the same item I have sold for 9 years .... same picture same description only to have someone ship back a box with a rock in it.

I am surprised he shipped back an engine. STUPID ON BUYER PART CAUSE YOU MIGHT BE ABLE TO TRACE THE ENGINE TO HIS CHASSIS.

In California you can only represent yourself in small claims court no lawyer present unless you are a lawyer.
 
How did he return the other motor...

I hope it was by the post office .... if so, its mail fraud, a federal crime....and the postmaster in your area will get involved.
 
A "friendly" dealer or tech on the forum might be able to see if the numbers on the cases you got back match your sellers name... like Don said.
 
tell us what your username is on Ebay... we can find this string of bad feedback and figure out the buyer...

did he have a bad rep?
