Need a little advice atv related

Sorry I know this is the wrong place but thought maybe some of you could help.
I have a 2004 Suzuki lt50 it had a lien holder on the tittle and i didn't check it yea i know It was a dumb thing to do. But anyway I have been trying to get it for 2 years. 1 year on my own because the previous owner gave up and said you deal with it.
Now this is where i am to date. lean holder has went out of business quite some time ago and can no longer sign it off. It has been paid for sense 2005 but title is basically no good sense it cant be transferred. so what im asking book on it is 580 to 725 I was thinking of trying to sell it for maybe 300 bucks and fully disclosing all of the above information. can i legally do that and do ya think anyone would be interested in something like that? it could only be used around the farm or someplace where you could ride it without registration.

Let me begin by saying that I am NOT licensed to practice law in the State of Idaho. Having said that, most States have a procedure for this exact event, and it's usually fairly simple to do. Usually it goes something like this:

"If a lien or security interest holder is out-of-business, a motor vehicle owner is not required to submit a release to secure a new title; provided, they obtain and submit a letter from the appropriate regulatory agency, see below, that states the lien or security interest holder is no longer in business or is unlicensed.

When the letter states that the lien or security interest holder is unlicensed rather than no longer in business, a letter must be mailed registered mail, return receipt requested, to the lien or security interest holder at their last known address shown on this Department's title records. The returned undeliverable unopened letter must be submitted with the U.S. Postal Authority's green registered mail card intact along with the letter from the regulatory authority stating the company is unlicensed, and the other documents and fees required for title issuance."

I have to imagine Idaho has something similar. Have you spoken with somebody down at the DMV?

I did that and the letter was forwarded to the last acting person of the company which called me and the dmv to state that the company was out business and i asked them ok I will send another just reject it and i will be on my marry way. they accepted it again and called saying same as before. The only option here under Idaho code it wait till its 10 years old then its no longer applicable according to the dmv and i can get a free and clear title. But i need it gone my daughter wants a bigger one and i have no space to keep it until then.

you should get 600 easy. since you can't get a new one. but then again you won't get parts either soon
 
I would buy it with out a clear title if you didn't live so far away from me.
 
I'll take it without documentation if thats how you end up. I buy these little ATV's and bikes and trade them to local kids for good behavior/grades. When they out grow them I clean them up and send them out again.

Wow, another good deed by ErcW???? If you were near my area I would buy you a :beer; for sure, good on you for working with the youth...

Wow that's great I will see what i can get figured out on it first may just take some more time to get it cleared But anyway it works out I would make you a hell of deal for the good deeds :beer;
 
I've had great luck with this program keeping kids on the strait and narrow. I only have had 1 kid last year not sign the agreement below. I even bought him a new 90cc ATV and let him sit on it in my shop, he wanted that thing bad. After meeting with his teacher and looking at the chore chart that was made up with his moms help, he said no way was he willing to "do all that stuff".

I gotta give it to the kid, atleast he was honest. He told me he would rather not have one (ATV) than to have one for a while then loose it or leave it parked. I guess a mans got to know his limitations even at 10. I still hang with him once in a while and he always makes me laugh at his take on life through his little eyes.

I've got a LT-50 that I bought new in 1987 that has been in circulation for over 20 years now. Just added chain/sprocket and tires, a quick paint job and back out.

Take a look at the contract I wrote up for this deal, I'm open to suggestions. Let me know on the 50 AJ. EW



ATV/Motorcycle/Snowmobile Use Agreement




This ATV/Motorcycle/Snowmobile use agreement is between ______________________________, user, and
________________________________, owner. This agreement is designed to set rules that once met by the user will result in the user gaining the privilege of having and riding the owners A/M/S. The agreement is based solely on the user complying with the terms established by the owner. If at any time the user does not comply with, or violates the terms of the agreement, the use and privilege of having and riding the users A/M/S will be terminated for a period to be determined by the owner.

The conditions for complying with this agreement are as follows:

1. User will always wear a helmet while operating the A/M/S. Not wearing a helmet will result in a 1 week loss of use on the first occasion. If a second incident occurs the user will loose use for 1 month. A third incident will result in total loss of use and user will return A/M/S to owner.
2. The user will maintain satisfactory grades, attitude, and class conduct. User will provide owner with copy of school transcripts to verify compliance. Any discipline required at school will also result in loss of A/M/S use. Owner will communicate with users’ teacher/principle to verify compliance.
3. The user will maintain good conduct and attitude at home. The user and users’ parents will create a “chore chart” list of requirements that must be met prior to daily and weekend A/M/S use. Non compliance or discipline at home will also result in loss of use.
4. The A/M/S must be kept clean, in good condition, and treated with respect. User will be responsible to pay for any repairs caused by negligence or irresponsible riding.
5. Any illegal use or riding of A/M/S will result in complete loss of use and the A/M/S will be returned immediately to the owner.
6. Any illegal acts conducted by the user such as theft, drugs, alcohol, bullying, malicious mischief, etc. will result in complete loss of use and the A/M/S will be returned immediately to the owner.
7. Additional requirements and compliance may be developed by parents and/or owner and attached to this agreement.

To be clear, the A/M/S belongs to the owner. User is only granted use of owners A/M/S by complying with the terms of this agreement. User will return A/M/S to owner at owner’s discretion or when out grown.

By my signature below, I agree to the terms of this agreement.

My brother in law is going through some similar situations. We too are in Idaho and it is working out well for him, so this has to work for you as well.. He has 2 machines. 1 is an 89 Kawasaki Bayou 220 ATV and the other is 96 Arctic Cat Powder Special. Both are from out of state, but that shouldnt matter. When the VIN inspections was done on the Bayou it came back as stolen (no title when bought, figured it was too old since Idaho didnt have them till 91). Police did not impound, but did the foot work to find out it had been stolen out of Texas and insurance had already paid the claim so now the insurance company owned it. The insurance company was called and they have no interest in it since it would cost more to get it back to Texas than its worth. The State inspector sent a certified letter to the insurance agency. They have 30 days to respond. If no response, the new Idaho title is free and clear in his name. Now with the Arctic Cat. He bought it with a title from a guy in Utah. The guy who sold it to him and gave him the bill of sale was not the title holder. The title had been signed over by the owner, but another buyer (not the guy he got it from) had signed as the purchaser, never put it in his name, and sold it to the guy my Brother in law got the sled from (Kind of like your lien holder situation). Now a certified letter was sent to the guy that was the original purchaser (first guy that bought and signed it and never transferred to his name) and they accepted the letter, but again, never responded for 30 days. He now has a new Idaho title in his name for this Arctic Cat. I guess my LOOONNGGG drawn out story was basically this: If the letter is sent, it should not matter if it is accepted or not. Its only if they show interest by responding to the letter that this would cause a delay. The state inspector is who sent both letters for him so if they respond, it is directly to him. So far my brother in law has done this 2 times and has been successful both times just because they never responded. Your situation may be different because his vehicles are older than 10 years old and it may also be different due to having a lienholder, but I thought it may be similar. Dont speak with the DMV, they are never any help here at all. If you can, speak directly with your State inspectors local office and see what they have to say. Sorry for the long explanations:D

You know i don't know why i didn't think of that I will call her as i have had to deal with her before on getting a new Vin for a trailer i built. thanks for the info and advise :beer;

Man that's awesome that you do things like that it makes a positive outlook on life for the kids helps teach them responsibility your a great role model :beer; I will let ya know soon as i get something figured out I would like to see it threw as i hate to feel beat :D
