Malcom Smith to Protest Youth Ban on Motorcycles/ATV's/Snowmobiles

Thought I should post this from Cycle News:

A recent press release from Resource Marketing announced Malcolm Smith was taking action against the kids bike ban under the CPSIA, and that he will lead a protest at Malcolm Smith Motorsports on Thursday, March 19.

The release stated: "Our hero and friend Malcolm Smith is mad as hell and he's not taking it any longer so he's committed to staging a protest against the latest CPSCI Act which restricts the sale of motorcycle and ATVs to kids."

But to call it a protest would be an understatement. There will be a bit more than picket signs and chanting... Come Thursday, Malcolm is going to disregard the ban and start selling youth OHVs. Jeremy McGrath, Jeff Ward and Troy Lee have already announced they plan to take part in the protest and purchase youth bikes from Malcolm Smith Motorsports on Thursday.

Right now, it's anyone's guess as to what the repercussions of this bold move will be, but one thing is for sure: Malcolm is not willing to spend another day not reacting to the CPSIA and the devastation it has had on the front lines of our industry - our dealers, who have investetd their lives into the sale of OHVs.

Why: In defiance of the Consumer Product Safety Improvement Act of 2008 which prohibits the sale of youth motorcycles and ATVs deemed unhealthy for children under 12 due to suspected high-levels of lead content, motorcycle dealer Malcolm Smith will sell these banned vehicles as a sign of protest. As a sign of support, a group of small business people and high-profile motorcycle industry celebrities, including racers Jeff Ward and Jeremy McGrath, Glen Helen Raceway owner Bud Feldkamp, and motorsport design guru Troy Lee have all agreed to be on hand to purchase banned units for use by their own children and grandchildren.

Poacher, you're behind the times. This is the law that caused all dealers to pull all the small ATVs, MCs and snowmobiles-- its here, its real, and its a disaster. The people offering to sell and buy these machines are actually placing themselves in the line of fire. I hope they are lawyered up.
I guess the proponents sleep better at night, knowing the kids won't be getting lead from licking their battery terminals and have one less family activity and one less reason not to play video games.
 
While this may all look sunny for the youth OHV industry, there’s a third exclusion that is proving to be problematic...


"The Commission may exclude if... lead in such product or material will not result in the absorption of any lead into the body..."

What’s the problem there? Well, the law says “any” and not “harmless trace elements.” The report put together by the MIC and SVIA which originally sought the exclusion, showed that a child touching parts of a dirt bike and then licking his finger would result in a trace amount of lead being absorbed into the body – we’re talking less than drinking a glass of water. Still, the CPSC is interpreting “any” to mean “none whatsoever.”
Believe it or not, that single word is the hurdle standing in our way.




So how long until congress bans kids from drinking water?
 
so i heard 400 day you won't be able to get parts for these either. is there any truth to that.
 
Good to see someone taking a stand. Kudo's to those guys!!!

There needs to be more in the way of "protests" going on to show that this isn't acceptable.
 
wonder if there is a way to take up a collection so people could donate towards a fund to purchase an atv or bike and then we could hold a fundraiser for BRC using the purchased kids OHV.

Just a thought.

Not to mention the injuries resulting from youths learning to enjoy these sports on larger "legal" vehicles! "Son, quit chewing on that hood, it's full of lead!" :eek:

Being from Canada, im sure it will make its ugly way up here one day so that we too can ridicule the lack of common sense oozing out of the city politician.

From what I read, Malcolm will need every ounce of support he can get, every shop must know about this and they must all act together. In fact , they should all start selling on the same day...they can't control whats allready out of control.

I would be willing to contact shops here in Calgary and Im sure there are more folks in here that would be willing to do the same to organize a North American protest to a law that should not be passed. All i need is a contact email to send our support too. Numbers speak louder than words as they say.....

You can all start by SIMPLY and QUICKLY signing this petition at the bottom of this webpage: www.tomself.com

Then go here (ARRA website) and fill in your info under where it says "Send this message" then click the button to send the letter to your Senators and Representative and Members of the Senate Commerce, Science and Transportation and House Energy and Commerce Committees. They all will recieve it by fax. Took me only a couple minutes to read through the letter, add any thoughts, fill in my info then click send. EASY!
 
So that's what's wrong with me

Been riding dirtbikes since I was 12 and nothing wrong yet! Well sort of.... Love the smell of 2-stroke in the morning! Malcom in "On Any Sunday" is still one of my all time favorite reminders of the good old days when things were simpler:o I can't believe such an assinine law actually passed. Pretty soon we're not even going to be allowed to go out of our houses:mad:
 
In their quest to protect American citizens from evil, The Consumer Product Safety Commission is at it again. Our kids books are being called into question and libraries are being asked to remove older childrens books from the shelves due to minute lead levels in the ink. I wonder how long it will be before a lawyer gets the history of who the book was checked out to, makes contact with those people, and then files a class action suit against the book manufacturer for using lead based ink pre 1986? It has almost gotten out of hand. As soon as they ban kids bikes, computers, and video games, the revolt will be on and they will have to relax the laws.

The dealers around here still have kids 4 wheelers for sale as well as sleds. So was there some kind of time limit to quit selling them? If they were susposed to stop right away it's not working here. What about all the stuff thats already out there? Can kids still ride that? Sorry but i'm not up on the details Enlighten me if you will.

If you have kids, and they need a motorcycle/snowmachine/even a quad, sell your favorite machine, buy something simple to get by for yourself and the best you can afford for them.

If they don't apriciate what you did, leave them home and take the neighbors kids out!:)
