Just to protect people so no names will be used. I have a good story about the man getting whats due to him when all said GFY from corporate.
Quick recount of whats happened is this person and there team was getting WAY to much OT in a office job. Constantly badgered to get OT approved or no pay etc. etc...meanwhile BEGGING for more help. The demands of there product where very high specially with this housing crisis. Corporate was pushing and pushing for more to keep up without hiring new hands. Then a greedy company manager/attorney comes in and changes there job titles and adds in "SALES" into there title.
This gave the manager/company attorney a loop hole that could work these peeps to the bone without paying any OT and putting them on salary. Heck he even laid off people to increase his margins while employees worked 10 plus hours a day taking work home on top of that.
Then to top it off year end #/s looked so great to corporate at this location they freaking give the head man a huge bonus. All this while the other 7 locations cant do it. This should of tipped corporate off as well but greed was the winner.
Anyway people had enough and they lost most of there good people but being as this housing crisis was such a push to there product business just stayed at top levels. AND, the management even BOASTED about how they had manipulated the labor system and made comments after the labor board was involved...."there is nothing they can do to us, we are legally correct" and continued there behaviour.
My friend was one of those people that came to me constantly griping and finally quit to find a happier better place. But 1 year later my friend is having lunch with a ex-coworker STILL there trapped by circumstances we wont go into and this friend had a break down and was literally sobbing. My friend had enough, knowing how going to the labor board was to risky at time when employed there (not to mention the fear mongoring) this person decided to go ahead with a formal complaint.
BTW, in the interim after the labor board had a full on investigation going the manager died. This left corporate someone to hang blame on and claimed it was all him.
This process has been going on for over a year now and my friend got the call today.
It was determined the company could not exempt these positions and will be paying each of these 6 empolyees 2 years of back pay at the overtime rate using an average of 10 hours a week per employee for this location as well as 7 others.
This totals nearly a million dollars in pay for all these employees so I am sure the company will fight this. Anybody have any experience with these things? will this be settled to 50%? Is it possible the company can overturn labor boards? will it be settled in 2 years or less?
FYI, I also found out this company was fined for this same thing in 2001 so I really dont feel sorry for them!
