Here we go again GRS SNOWMOBILE REPAIR

Once again GRS Snowmobile, La PIne Or. is trying to find a way to worm his way out of a hole he has dug himself into.

For those of you that have been following the saga of Grs Snowmobile Repair, I present a question to you.

Grs has e-mailed me telling me that he is finally going to give me back my sled. At first I cheered but then I read further into the e-mail. Here is what he is going to do.
He is going to take my sled to some unsupectring shop in La PIne and leave my sled, and then he is going to give them a bill fo them to collect for him. Now here is the problem with that.

1. My sled is a Polaris

2. The bill is for an Artic Cat that I own and he supposedly worked on. I have no idea what he did to it but he chareged me $35.00 for the parts and his labor is free because he used my trailer to move his shop. I have paid him the $35.oo months ago. He gave me back the Artic Cat the first weekend in March, and now suddenly he feels that I owe him money. and if I don't pay this money to him for an amount that I do not know how much since I have never seen a bill or even been told how much or for what he did, I will not get my Polaris back unless I pay this bill.

3. Plus I have to drive about 150 mile each way to get my sled. Now in e-mails he has repeated told me that he would deliver my sled to me. At the end of March when I went to his shop to pick up my sled and he refused to give it to me, the sheriff was called and he promised the sheriff he would have my sled fixed and he would deliver it to me on the 30th of March. The 30th of March has come and gone,( he put my sled into LOCKDOWN) and I still do not have my sled.

I know that the obvious is to pay him this unknown amount of money and go pickup my sled. However I feel that this is extortion, on his part and he is using an unsuspecting business owner to do it.

I do not owe him anything. I do have e-mails and canceld checks for all repairs he has done. Lets not forget that he has had my Polaris for 11 months to fix / replace a fuel pump. Which is located under the airbox. I would guess that this task would take an hour maybe two at the most, but 11 months!!!!!

What do you guys think.
 
First thing I would do is get my sled back. Regardless of the driving distance. 35 bucks is a wash as far as im concered, weather hes right or wrong there is no way hed have my sled this long.
 
Usually if he has the sled and gives you a bill you have to pay it or go to court, But if you can access your sled and pick it up, ie you can go on any ones property or what ever as long as there is no breaking and entering and take what is yours. But if he calls the sheriff and claims there is a pending debt he can stop you from taking it. If you can grab it and go before anyone knows its all yours and he will then have to take it to court. Which it sound like you would win. But I don't know his side of the story so I wont pass judgment on him. Possession is 90% of the law.
 
Go to the shop and talk with the owner and show him everything about the crook he is dealing with, show him your receipts and cancelled checks.
 
I wouldnt touch the sled/or bill if you already have a small claims case filed..by paying anything now you admit to oweing him ...which he could then add more to when court time comes..also..as soon as you prove your case in court..the judge will order him to produce your sled...period..if he doesnt the judge can site him for contempt,even jail him,and..if he doesnt produce said sled , you can ask the court to order the sheriffs office to acompany you onto his property to retreive it...I would go to this dealership..explain the situation, ask them to hand the sled over(bring any ownership paperwork/ court papers along...and I would take pics of it from every angle..but if they wont hand it over free and clear..I sure wouldnt pay for it...
 
one thing about the court..they are slow..but generally they get things figured out right..just takes time...they kind of sit back and watch to see who screws up...do things by the book...dot all your i's, and cross all your t's...not like you havent done with out the sled for a while already..a bit more isnt going to kill you......
 
in oregon in is against the law for an auto repair shop to hold personal property, no matter how much a customer owes you. i would check into this. would think the law would be the same for all motorized repair...
 
Gordon(GRS) is a liar and a cheat. I hope your polaris wasn't the red 2005 or newer I saw at his place with no motor! That was back in November though.

You all need to understand you can't just call and ask what you owe him, he won't answer his phone or if your lucky he will text you after calling saying "no calls send email". He may reply to your email explaning how busy he is and that he will get to your sled when he gets to it even though he's had it for MONTHS Just for a simple 30min task like aligning clutches. But most the time you just get "I never got that email."

Once you arrange to pick your sled up he will tell you all about all the other items he had to fix even though you did not bring it there for those issues but he will expect you to pay.
 
Wow! Twostroke...sounds like you know the Gordon, I know! That red sled with no motor was MINE. And he sold it and never paid me for it!! We sued in Small Claims, he agreed to pay - AND DID NOT!! It's been gone for almost SIX months and I have NOTHING but lies and excuses...oh, I do have a judgment against him, which gets me more NOTHING.

Every person I have ever talked to that has had work by him gets treated the same....I just hope everyone stops going to him so that he has to get a real job and they can garnish his wages to pay me back!

because of the threats on face book and what you have done to past Boy friend and husbands. there is no man out there that should ever sleep with you!!! you are an evil lady and you stored your sled at my house for free for a YEAR plus you expected me do do the labor for free. or for the little bit of wood you would get me (never ever as much as you said it was.... remember a cord of wood is 128 cubic feet stacked not thrown in a truck). (oh yeah i worked in a wood yard too)

It's pretty easy to see that this Gordon guy is a real piece of work.

Dude, just pay the people back whatever you owe them. Then lay off the meth, it's bad for you.

Are you serious? You're gonna come on here and accuse HER of being a liar? After all the obvious evidence against you, not to mention the PUBLIC RECORD court cases against you? HAHAHAHA...best laugh I've had in a month!

Go away scum. You're giving snowmobiling, and central Oregon a bad name.

I don't get it. Why wouldn't this shop owner just distance himself from this problem, give the sled back. Your business is going down the tube. For a guy who only wants to communicate by email, he sure has a hard time making sentences that make sense.

I can prove that Gordon Shields of GRS Snowmobile Repair (A.K.A. clutchman) is a liar and a thief, as I have an official document from the Circuit Court of the State of Oregon for Deschutes County - Case No. SC110769c - Judgement Lien per ORS 18.078 and ORS 46.485 for $1,622.00 + 9%/year interest.

He sat right across the table from me in court and promised me and the courts that he would make payments, LIAR! He has not paid us anything.

If anyone would like proof, just look up the case number, it will show "Unsatisfied"...Gordon is a real piece of sh!t.

If he had my sled for 11 months there's no telling what I would do.

I do! he would need to call the Sherrif on me!

cut him into small pieces and feed them to your dog

thats what happen in these case even if you do "WIN" you still lose . Not exactly the "JUSTICE " you might hope for .

Find someone to beat the piss out of him! Closest to justice your likely to see.
 
Something to think about;

If a person (licensed repair facility) has repaired, furnished supplies or materials, towed or stored a vehicle and has not been paid for the services rendered, that person has a lien against the vehicle. The lien arises at the time the registered owner is presented with a written statement of charges for completed work or services. Although if services were performed that were not agreed upon and no written and signed estimate was issued beforehand, a mechanic has no right to keep the title owner from reclaiming the vehicle. If a mechanic asserts a fee that is not reasonably related to the work performed, and refuses to return the vehicle until that price is paid, the owner of the vehicle will be able to recoup a storage fee from the mechanic, as the mechanic is in the wrong for refusing to return the vehicle. In doing so the mechanic would commit the crime of conversion, or Embezzlement.

With that in mind, I've had unfortunate dealings with chem-heads before and this guy's responses are exactly what I encountered in their business dealings. I don't know if that's what this guys problem is or not, but sure sounds familiar. They will tell you anything, usually to buy more time to bury/sell evidence and ALWAYS trying extort more $$$ from you or just get you to go away. Most of the time what they have to say won't even be related to anything that you can make heads-or-tails out of. Excuses are over-the-top and change constantly. They commonly shift back-and-forth between playing the 'victim' then suddenly they're 'going to kick your a$$'. In the end, you WILL lose your money AND property! It doesn't matter what you "win" in court, as all you will get is a piece of paper that says they "owe" you. You will NEVER be able to collect on it. Been there, done that.

The longer your stuff sits there, the better chance he has of claiming 'abandoned property' and selling it. Easy to do if he comes up with any documentation (real or otherwise) of when he got ahold of your stuff to begin with, and when he supposedly "finished the work" on it.

All of you that have a sled or parts held by this guy might think about getting together all your ownership documents and other 'evidence'. Then pick a day (privately, amoungst yourselves) to all meet in LaPine. Then ALL go together to the Sheriff's office and let them know that you are there to reclaim your property from this guy and request their attendance. Then, GO GET YOUR STUFF, or what's left of it. I'm sure that whatever you left with this guy is either already gone or being parted-out, so good luck. The longer you wait, the less you'll find....
