Are fuel check stations legal or are they a violation of private property rights? I thought that a warrant was needed to search a private vehicle.

Not wanting to start a war, I just don't know. Any help would be appreciated.
 
Are you talking about diesel? I think there is a federal regulation that allows State Troopers to check your diesel fuel to make sure you are not running farm diesel.

It's kind of one of those things like taking a breathe test if they smell alcohol. I know each state is a little different as to how they do it and fines and all that garbage, but they have the freedom to dip your tank just about anywhere...

Pops works with motorfuels tax for ND, he's passed on quite a few stories about people trying to beat the system, mostly MN. Pretty funny stuff...
 
I'm not hiding anything, just had a friend that saw a check station on the side of the road. He drove right on through without stopping and took the next back road he could find.
 
pops told a story where they tried catchin a farmer in MN they knew was breaking that law, waited for him to go to coffee, then blocked both main drags with check points. Said they never saw so many people leaving side streets in their lives, word traveled quick and sounded like just about everyone in town was busted at least once.....
 
It really depends on the state. In Colorado they would have to get a warrant. Unless they had some sort of probably cause, which I really can't see them obtaining unless they actually saw you pump the dyed fuel.

If they don't have probable cause they would need a warrant.

Why not just run what you should be running?

On that note, if you leave dyed diesel in the sun for a few days the dye will bleach out. It is just like leaving your nice Boss seat in the sun. The sun fades all dyes equally.

I had an old friend in CO run an extra tank in his truck that was hidden under the tool box and was a cean look all the way to the bottom of the box cab. Impossible to know unless you knew it was there. Had a small switch to go from either tank inside, every dip was clean but the dyed got him to CO to ND and back no probs without a stop!!!!
 
even with the dye being bleached out if they used the sniffer...which they would never bring out they could tell your on dyed fuel

How?

The dye is the only difference.

Although I have read reports that dyed fuel doesn't have as many lubrication additives in it, so you might run a little bio-diesel for lubrication.
