ebay question

Bought a pc of industrial equipment on ebay
ad said it was certain year of machine and the hour meter coincided with typical use. Paint was good and the machine looked legit, so the asking price also seemed legit

got the machine here and found out that in fact the machine is 10 years older than the ad stated.

Spoke with the seller numerous times during the transaction and at no time was it mentioned by him that the machine was being represented inaccurately


My question is this, is there any legal recourse to recoup a portion of the cost?

I had told him I managed to sell it however I told him I had to take a loss being that the machine was now overpaid for considering the year.


it was a US - Canada deal so I am guessing it would be hard to pursue???

You can get money back for this type of transaction through e-bay, through pay-pal and through your bank/credit card.

The problem is that you SOLD it. Generally you have to return the item.
 
Kind of a tough one, but with Paypal, ebay and credit card companys it does give you a bit of hope, but like the above said, you sold it. I would think you are out of luck?
 
Afraid your SOL, as you sold it.

You could have gotten your money back through ebay, the seller would have had to pay any shipping charges related to taking it back, the item was misrepresented and that in itself would have been enough for ebay to step in and handle it, if not you would have had legal ground to stand on since it is a legally binding contract and they misrepresented the item.

Your next step.... leave feedback and don't hold back. I would still report it to ebay just so they are aware of his tactics but there is likely nothing they can do about it now. Wouldn't hurt to post his user ID and even the transaction number, never know when one us might stumble across something from the same guy.
