Just another heads up about the hearing tomorrow at Yakima County Superior Court concerning the Crystal Springs Sno-Park.

The hearing location is as follows:

2:30 PM
Thursday, December 1st, 2011
Yakima County Superior Court
2nd Floor
25 S. 3rd Ave
Yakima, WA


Judge Suko will be hearing the case.

Please be in attendance if possible and on our best behavior.

I plan to be there and will report by Friday on attendance and possible outcome.

This is in the Federal Court Building, address is correct, 25 So. 3rd. St.. Try to come early, there will be security. see you there.
 
So, how did the hearing go? Wish I could have been there, but couldn't get away from work. They should have had it on Friday. Ha
 
2-0! Injunction Denied

Yesterday was a great day for the judicial system as the plaintiff's were denied their injunction:face-icon-small-hap. From my view, the judgement was fairly broad and wisely thought out.

This case was different than the 1st one; no mention of the first plaintiff's, just the Kittitas County Fire District. However, I am not a legal expert and may have missed something.

Hopefully, there seemed this time to be good will towards the recreational community, and several statements from the plaintiff about their intent to keep the sno-park open to winter users. There also seemed intent by both parties to work towards a resolution that would work for both the fire district and recreational users. IMHO, negotiation is always better than litigation in the long term for both parties. I also have a great deal of respect for anybody that volunteers their time for emergency services, and hope for a suitable common sense resolution concerning the fire station/garage that does not impede on our established recreational uses.

Attendance by snowmobilers was in excess of 26, with at least 8 Yakima Ski-Benders in attendance. I felt there were about 9+ people on the side of the plaintiff. Both parties were well behaved:becky:.

WSSA petitioned a intervenement(?), this will be heard on 12/30/11.

Thank you to all who attended, we can not afford to lose any sno-parks!

I agree with all that Tamp said. The Plaintiff was under the obligation to prove four points in order to gain the sought after injuction and Judge Suko explained very clearly how they failed to prove any of them. As in Zero.

I feel I have a better understanding of options now that I've heard from both sides and have seen the photo's (8 X 10 glossy photo's with circles and arrows :face-icon-small-win thank you Alice!)
Quite frankly I have never been to CS snopark, but now I see very clearly what the issue is and understand much better why the plaintiff's desired injuction of plowing the road for "duel purpose use" is a non workable suggestion.
I'm glad that I went.
Thanks to all that did show, and yes, it seemed to me that all behaved very well except for the one guy that tried to sneak in a Leatherman . . . :face-icon-small-sho:face-icon-small-con:face-icon-small-dis
