There might be others that are going after Mr. Clutch douche that might get a case number and NOT go into mediation.
Would you recommend to others that they use mediation or go straight into court and let the judge sort it out, or does he have the option of taking it to mediation if he so chooses?

As long as he responds to the Smalls Claims Served paperwork, he can choose. If you go to court, you don't get the chance to explain your story. In mediation you each get a chance to explain your case and the mediator will work through it with you. The Judge can't/won't go over it with you, the Judge will want to know if you have a contract. Most of us don't. Who gets a signed contract when they drop their sled off to get worked on at a shop you've spent thousands of dollars with in the past ten years?
In the court room someone wins and someone looses. I still know we would have been awarded at least what Gordon offered to pay us in Mediation. We still wouldn't have received the rest that we were asking for, most likely because the whole no-contract arrangement....though, we have everything in writing, still not a contract.
It really doesn't matter what you choose to do. Gordon has his attorney on speed dial, his attorney keeps him one step above the law at all times. He's been through this before. Basically what everyone (authorities) says is that it's not against the law to do bad business. He's been turned into numerous government agencies for various infractions by various people that have been taken advantage of by him. He will get his, it just won't come in the form of restitution for any of us that have had issues.
