Mediation!

GRS has chosen to have our Small Claims case go to Mediation. This should be entertaining, to say the least! I'm sure he will try to pump the Mediator full of BS and lies....it is too bad we have to sit across the table from him. I was hoping to never see him again! Not to mention it won't bring us a dime.

Mediation Today....

For anyone that's been following this...

We met with the Mediator at the Court House today with GRS (Gordon).

GRS agreed to make us payments. If he misses one payment, we automatically get to file a judgment against him.

He whined about his move, his ankle, how mean we are , how we are trying to take his business down on Snowest. (we didn't even start this thread) He also said he is keeping my parts (SLP pipe/can, motor, Team Roller Clutch) to sell to help him pay us back! WTF. Because we didn't have a signed contract we can't really do much about the parts.

Also, he generated "evidence" against us. These are two invoices dated 12/2/10 and 12/31/10. The one from 12/2 is Invoice #1311 and the one generated 12/31 is Invoice #1297. Hmmmm....dates are backwards from the Invoice numbers, wonder how that could have happened. The one from the 31st is from the sale of my sled, which he didn't even meet the guy to sell it until 1/2/11. More BS.

This guy is sort of like Bin-Laden....... It took some time, but in the end he got his "just desserts"

we did have a verbal agreement to sell it for $1500.00 and i did!! and you get your money. if i have parts left over after the the chassis was sold. it is just how it works. YOU NEED TO TELL THE TRUTH HERE JOEY/BECKY.

I love the fact that this thread has stayed on the first page for over a month!! People need to know about Gordon. Long story short, I sent him my cases and crank for inspection last July, he checks it all out and says no problem, line bore the cases and new rod pin. Quotes me 1600 for rebuild with new topend and going through clutches. I send him a check for 1100 to get started and then send the rest of the motor and clutches to him in August. He gets parts and says all looks good cylinders are good everythings fine. We talk end of August/First of September and set a date for my to bring my chassis down for install the last weekend of September. He calls the Thursday before and says he doesn't have the cases as he sent them to indy dan. we try to set up times in October but it doesn't work out. Set a date for first weekend in Nov. He calls the Thursday before and tries to cancel. I tell him no way you said the motor is sitting on your bench it only takes a couple hours to put it together, I have motel reserved I'll be there at noon on Sunday like we planned. I show up at noon as planned and the motor is still sitting on the bench with no head on. Gordon also tells me that one of my cylinders was bad but he put "his spare" on and we'll call it even if I buy him dinner that night. I leave my sled and trailer and head into town to find the motel. About 7pm Gordon calls and says he is beat and needs to eat. He comes into my motel and I take him to dinner. I ask if the motor is in he says not yet but it is ready to drop in. I'm not very happy but tell him I have a long drive home in the morning and it needs to be ready to go by 10 am. No problem. Gordon calls at 830 the next morning and leaves message, no way he will be done, now a bolt to hold the water pump hosing is stripped. Gordon now wants me to leave the sled and mt trailer at his place and he will deliver it or meet me the next weekend. I drive straight to his shop. The motor is still hanging in the air and no where near ready to drop in. I tell Gordon that I can give him until noon but that is it and the sled WILL leave with me finished or not. I go back to town and checkout, I get back to his place about 1045 and it appears Nothing has changed. Finally about 1130 after watching him dink around with stuff for over half hour I tell him its time and start trying to round up my parts that are here, there and everywhere, even in his house!!! I drag my sled back on my trailer load boxes of bolts clutch parts and stuff in my truck. Gordon then hands me two invoices the original for the agreed 1600 ( even though the work was FAR from complete) and another one for 500+ I gave Gordon another check for 500 to settle the agreed on price (even though work was not done) and told him to pound sand on the made up invoice. I am VERY thankful I did not leave my sled and trailer there like he wanted!!! This is the highlighted version, luckily I got my sled back even if in pieces. One other quick note when I was rounding up nuts and bolts he could not find a couple bolts for the carb boots so he took them off of a sled outside, he said it was his sled but who really knows. I have lots of pics of the condition that my stuff was returned in and a long list of missing and broken things but I will keep those to myself for a while in case Gordon decides to crawl out from under a park bench and sue me for his made up invoice

How about the fact that the invoice dated 12/2/10 included work that did not happen until 1/2/11?! Or how about the fact we had a written agreement, not verbal for you to sell any and all parts for 20%? I could spend my whole day going through "the truth" with you.

Who is the one that is not telling the truth here? Sounds like the same as it's been all, along.

We have been told we would receive payment before.

Work on my chassis?? You had my chassis in your posession for about 24 hours, during which time you were supposed to install my motor. Maybe you are referring to the front motor mounts you asked me to bring just in case. I know you changed the one and then said the other was to hard. Don't worry though when I got the sled home I pulled the motor back out ( it had been temporarily set in place for the ride home) and replaced the other one. That had to be almost the hardest five minutes of my life!!

As far as the cylinder goes, the ones I sent you were in very good shape (I tore down the motor) and this was verified by not only me but also a buddy. I also found the email from you after you had recieved my parts saying that everything looked good!! Then magically the week I am supposed to come get everything done my cylinder magically needed to be re nicced???? More likely after seeing your shop set up and amazing organization you simply missplaced my cylinders and decided to try and make it look good.

All I can say is thank God I didn't leave my sled and trailer with you like you wanted, I probably wouldn't have seen them again...

And now we'll wait for another middle of the night reply from the "midnight mechanic"

Missed Court Ordered Payment by GRS

Well, Gordon Shields (GRS) got to pick his own payment plan with the court system to pay us for the sale of my sled from 1/2/11. He choose to make his first payment to us by today at 5pm. It is now 5:25pm and guess what? Another LIE!! No payment, the first thing on my list of "to-do" for tomorrow is to go BACK to the court house to file an immediate Judgment against him.

Gordon - why did you promise the courts to pay? Were they not clear about if you're ONE minute late, we get to file a Judgment, immediately? Another proof that you meet the definition of Liar in Webster. You have lied to us over and over again, and now to the Court System/State of Oregon. Will this ever stop?!!

Case #SC110769 However, we met in Mediation which is not recorded. He agreed to this at his own suggestion to pay us. Not because he was ordered to, because he VOLUNTEERED to do so. What a creep.

There might be others that are going after Mr. Clutch douche that might get a case number and NOT go into mediation.

Would you recommend to others that they use mediation or go straight into court and let the judge sort it out, or does he have the option of taking it to mediation if he so chooses?
